A factory licence application is usually delayed by documents, not by law. This checklist lists what you should have ready before you log in to the State portal in Delhi, Uttar Pradesh or Haryana, how each document is used, and the mismatches that trigger query letters. It follows the position in October 2026, when Uttar Pradesh has final OSH rules and Delhi and Haryana are still working on their existing systems with draft rules pending.
Use it with our detailed pages on factory licence registration, factory licence in Delhi, factory licence in Uttar Pradesh and factory licence in Haryana.
How to use this checklist
Collect documents in four bundles: occupier and entity, premises, factory plan and machinery, and dependent approvals. Then run a consistency check across all of them. In our experience a clean set with consistent names, addresses and load figures goes through scrutiny faster than a longer set with contradictions.
Bundle 1: Occupier and entity documents
The occupier is the person with ultimate control over the factory: the proprietor, a partner of a firm, or a director of a company. Only the occupier can sign the application.
- Certificate of incorporation (company or LLP), partnership deed, or proprietor's identity proof
- Board resolution or partners' consent nominating the occupier (a manager or employee cannot be the occupier of a company or firm)
- PAN and Aadhaar of the occupier and of the factory manager, with photographs
- List of directors or partners with residential addresses
- GST registration certificate and Udyam registration, if available
- Authority letter if a consultant or authorised signatory files on your behalf
Bundle 2: Premises documents
- Sale deed, registered lease deed or rent agreement. Check the lease term: a very short lease invites questions when you apply for a five or ten year licence
- Sanctioned building plan and, where issued, completion or occupancy certificate
- Land-use or allotment proof showing the plot is in an industrial area. Delhi grants licences only for units in conforming industrial areas, so this proof matters most there
- Latest electricity bill showing the sanctioned load and the consumer name
- Site or location map, where the State asks for it
Bundle 3: Factory plan, process and machinery documents
- Factory layout plan showing machine positions, aisles, exits, staircases, toilets and welfare areas, drawn by an architect or competent person
- Plan approval or construction permission order, where the State requires it before building or extending
- Manufacturing process flow chart
- List of raw materials, intermediates and finished products, with approximate quantities
- Machinery list with power rating in HP or kW, adding up to the installed load you will declare
- Stability certificate from a competent person, where the State insists on it
- For hazardous processes: site appraisal and on-site emergency plan, as the State requires
Bundle 4: Dependent approvals
- Pollution Control Board consent to establish or operate, where your industry category needs it (see pollution NOC)
- Fire NOC or fire-safety undertaking, depending on building height, area and State rules (see fire NOC)
- Building plan approval or regularisation proof (see building plan approval)
- Groundwater permission or water-supply proof, if relevant to your location
State-wise checklist at a glance
The core document set is similar everywhere. The differences are in the portal, the forms and what the officer is likely to stress.
| Point | Delhi | Uttar Pradesh | Haryana |
|---|---|---|---|
| Where you apply | e-District Delhi portal | Nivesh Mitra single window and the Labour Department portal | Haryana Labour Department portal (hrylabour.gov.in); Invest Haryana / HEPC for project clearances |
| Rules in force | Delhi Factories Rules, 1950 continue; Delhi OSH Rules still draft as of October 2026 | UP OSH&WC Rules, 2026 notified 27 August 2026 | Punjab Factories Rules as applied in Haryana continue; draft Haryana OSH Rules, 2026 not confirmed final |
| Premises condition | Conforming industrial area only | Industrial plot or permitted land use; Nivesh Mitra generates a unit ID | Industrial or permitted zone; check local authority land-use |
| Licence form reference | Online service on e-District; legacy Form 2 and Form 4 treated as old procedure | Form-45 for licence application under the 2026 rules, as reported | Portal-based; confirm current form on the portal |
| Fee basis | Installed HP and maximum workers; per year multiplied by years chosen | Matrix of installed power and headcount; reported range ₹500 to ₹38,000 | Haryana slab not verified by us; paid through E-GRAS |
| Query deadline | Three days to reply, failing which rejection and fee forfeiture | Reply within the time shown on the portal | Reply within the time shown on the portal |
| Validity options | 1, 5 or 10 years | 1 year first, then renewable up to 10 years | Auto-renewal for 5 or 10 years if particulars are unchanged |
UP form numbers, fee range and validity above come from secondary summaries of the 2026 rules; check the gazette or portal before filing.
Delhi: what to prepare in addition
- Proof that the unit sits in a conforming industrial area. Residential or unauthorised colonies are rejected regardless of paperwork
- Everything scanned in the format the e-District portal accepts, because queries are time-barred. Keep a person assigned to monitor the portal daily
- Fee computed on the maximum HP and maximum workers; the licence fee is the annual fee multiplied by one, five or ten years. The Delhi fee schedule runs from ₹100 to ₹20,000 per year
Uttar Pradesh: what to prepare in addition
- Nivesh Mitra login and the Common Application Form details that generate the unit ID
- Details for the rules' registration and licence stages. UP rules are reported to require a registration fee for smaller units as well, so check which stage applies to your headcount
- A list of safety committee, welfare officer and similar appointments if your headcount triggers them under the rules, which we have not verified against the gazette
- For the annual return and accident reporting, set up the responsible person and email at the same time, so they are not an afterthought
Haryana: what to prepare in addition
- Login on the Haryana Labour Department portal and E-GRAS access for fee payment
- If you are renewing, a check that occupier, name, address, maximum horsepower and maximum workers are all unchanged, because auto-renewal for five or ten years applies only if nothing has changed
- A note on any project clearance you hold through Invest Haryana / HEPC, since inspectors cross-check
The consistency check
Before you upload anything, lay these side by side and fix any mismatch.
- Name of the unit on the incorporation certificate, GST certificate, lease, electricity bill and pollution consent
- Address, including plot number and industrial area, across all documents
- Occupier's name and designation in the resolution and the application
- Installed load: the machinery list total in HP or kW against the electricity sanctioned load. A mismatch of the kind 20 HP declared against a 75 kW sanction invites a query or a higher fee slab
- Maximum workers: attendance and wage records, including contractor workers, against the number declared
- Dates: plan approval, completion and consent dates in the right order
Document quality tips
- Scan at readable resolution and keep each file under the portal's size limit
- Use one file per document and name it clearly, for example "lease-deed" rather than "scan001"
- Layout drawings should be legible at full size, with a scale, a north arrow and labels
- Keep original signed copies ready for the inspector's visit
Common document-related rejection reasons
- Lease deed unregistered or expired
- Occupier not nominated by resolution
- Layout plan that does not show alternate exits or welfare areas
- Machinery list that does not match the declared horsepower
- Wrong fee slab because maximum workers or HP was understated
- Missing reply to a query within the deadline
- Dependent approvals not yet applied for, causing the inspector to hold the file
Timing the documents
Start dependent approvals in parallel. Pollution consent, fire clearance and building completion often take longer than the licence stage itself, and inspectors ask for them. Take a dated acknowledgment of your plan-approval submission, because the OSH Code allows 30 days for the authority to decide on construction or expansion permission, after which it is deemed granted, and you need proof of when the clock started.
What changes if State rules change
Delhi and Haryana were operating on existing rules with draft OSH rules pending as of October 2026. If final rules are notified, forms and fee tables can change quickly. Always check the live portal for the current form number before filing, and re-confirm that the document list has not changed.

Frequently asked questions
What documents are required for a factory licence?
You need occupier and entity documents (incorporation proof, resolution nominating the occupier, PAN and Aadhaar), premises documents (deed or lease, sanctioned plan, electricity bill), factory layout, process flow chart and machinery list, plus dependent approvals such as pollution consent and fire clearance where your unit needs them.
Who must sign the factory licence application?
Only the occupier, meaning the proprietor, a partner of a firm or a director of a company, who has ultimate control over the factory. A manager or employee cannot be the occupier of a company or firm. Upload a board resolution or partners' consent nominating the occupier.
Do I need pollution consent and fire NOC before applying?
Often the inspector asks for them during the licence inspection, so start them in parallel. Whether they are strictly required before filing depends on your industry category, building and State. Missing dependent approvals commonly hold the file at the inspection stage.
Is a rent agreement enough for a factory licence?
A registered lease or rent agreement is accepted as premises proof in most cases, but the premises must be in a zone where industrial use is permitted. Delhi requires a conforming industrial area. Check the lease term and make sure the owner permits industrial use.
Why do applications get rejected for document reasons?
The common reasons are a non-conforming location, no occupier nomination, a machinery list that does not match the declared horsepower, an understated worker count and failure to reply to a query in time. Delhi gives three days to answer a query, failing which the application is rejected and the fee is forfeited.
Are the documents different in Uttar Pradesh and Haryana?
The core set is the same. Differences are in the portal, forms and fee basis: Delhi uses e-District, Uttar Pradesh uses Nivesh Mitra and the Labour Department portal under the UP OSH&WC Rules, 2026, and Haryana uses hrylabour.gov.in with fees through E-GRAS. Confirm forms on the live portal.
Do I need a stability certificate?
Many States ask for a stability certificate from a competent person, particularly for buildings housing heavy machinery or upper-floor factories. It is listed on the factory licence page as a document many States insist on. Check the checklist shown on your State portal.
