ESIC registration is the enrolment of an employer with the Employees' State Insurance Corporation so that eligible employees get medical care, sickness, maternity, disablement and dependants' benefits. The ESI provisions of the Code on Social Security, 2020 have been in force since 21 November 2025, and ESIC coverage is now extended across India. This page explains who has to register, how the 10-employee rule and the ₹21,000 wage limit work today and how to complete registration on the ESIC employer portal.

What is ESIC registration?

The Employees' State Insurance scheme is a contributory social insurance scheme for workers earning up to a prescribed wage. Employers and employees both pay a small percentage of wages, and in return the employee and family receive medical treatment through ESIC hospitals and dispensaries, cash benefit during sickness and maternity, compensation for employment injury and pension to dependants after work-related death. The employer must first register the establishment, receive an employer code and then register every eligible employee to issue an insurance number.

The Code on Social Security, 2020 merged the ESI Act, 1948 and other laws into a single code. According to the Government's release of 21 November 2025, ESIC coverage and benefits are extended pan-India, the scheme is voluntary for establishments with fewer than 10 employees, and it is mandatory for establishments with even one employee engaged in hazardous processes. The earlier rule that coverage depended on notified areas has therefore fallen away.

The Labour Ministry's FAQs issued in 2026 confirm that until the rules are finalised, the ₹21,000 per month wage limit notified for ESI coverage will continue to apply, while the Code's definition of wages applies from 21 November 2025. This is a point where employers should watch for fresh notifications, since the wage threshold can be changed by the Government.

ESIC registration is separate from PF. The wage limit, rates, forms and portals are different, although the headcount and payroll data are the same. Most employers register for both together, and this page links to the related PF process.

Who needs ESIC registration?

Under the Social Security Code, the ESI scheme applies to establishments according to type and headcount. In practice, the following employers need to register or consider registering:

  • Factories and manufacturing units with 10 or more employees
  • Shops, hotels, restaurants, cinemas, road transport, newspaper establishments, private educational institutions and medical institutions with 10 or more employees
  • IT, services and trading companies that have 10 or more employees and fall within the Code's coverage
  • Any establishment with even one employee engaged in a hazardous process, regardless of overall headcount
  • Employers engaging contract labour through contractors, where the principal employer must ensure coverage as per the Code
  • Establishments with fewer than 10 employees that wish to cover staff voluntarily

Benefits of ESIC Registration

Medical care for the family

Insured persons and their dependants can receive medical treatment under the ESI scheme without paying per-visit charges, which is a significant benefit for lower-wage staff.

Cash benefits

Sickness benefit, extended sickness benefit for certain diseases, maternity benefit and disablement benefit give income support when an employee cannot work.

Employer's liability cover

Where an employee suffers an employment injury, the scheme's disablement and dependants' benefits can reduce the employer's direct exposure under other labour laws.

Compliance for vendor audits

Principal employers and large buyers regularly ask for the ESIC code and latest contribution challans before approving a vendor or contractor.

Better staff retention

A visible ESI and PF package improves hiring for factory, retail and service roles, where employees compare overall benefits rather than only gross pay.

Eligibility & applicability

Two tests decide the position: whether your establishment is covered, and which employees are covered. Check both before registering.

  • Establishment is a covered type and has 10 or more employees, or has at least one employee in a hazardous process, or opts in voluntarily
  • Employees whose monthly wages do not exceed ₹21,000 are covered under the notified limit that continues until rules are finalised
  • The Code's definition of wages applies from 21 November 2025, so allowances and components should be classified accordingly
  • Employees must have an Aadhaar and bank account so that insurance numbers and benefits can be issued
  • Apprentices and contract workers are counted as per the Code; the principal employer must ensure contract labour is covered
  • Employees earning above the wage limit can be excluded, but if wages fall back below the limit coverage resumes from the next contribution period

Documents required

Establishment documents

  • Certificate of incorporation, partnership deed or proprietor's proof
  • PAN of the establishment
  • GST registration, Udyam or Shop and Establishment registration, where available
  • Factory licence or contract labour licence where applicable
  • Bank account details with a cancelled cheque or bank statement
  • Proof of address of the establishment, such as rent agreement or ownership document

Employer documents

  • PAN, Aadhaar and contact details of the proprietor, partners or directors
  • Authority letter or board resolution for the person filing
  • Date of commencement of the establishment and date on which coverage began

Employee documents

  • List of employees with name, date of birth, date of joining and monthly wages
  • Aadhaar, mobile number and bank account of each employee
  • Family details and nominee information for the insurance record
  • Passport-size photograph where the portal requires it

Step-by-step ESIC registration process

Employer registration is online. The steps below are how practitioners usually sequence the filing; portal screens may change as ESIC updates it under the Social Security Code.

  1. Confirm applicability and employee list

Count all employees including those via contractors, check whether any employee works in a hazardous process, and list who earns up to ₹21,000. This decides if registration is mandatory or voluntary.

  2. Prepare establishment and employee data

Keep PAN, address proof, bank details and a clean employee sheet with correct names, birth dates and Aadhaar numbers. Mismatches with Aadhaar are the most common cause of delays.

  3. Register the employer on the ESIC portal

Create the employer login, enter establishment details, owner particulars, nature of activity, date of coverage and bank details, and upload documents. Companies and LLPs usually file with a signatory authorised by resolution.

  4. Receive the 17-digit employer code

After verification, ESIC allots the employer code number. Download the registration certificate and keep it available for inspection, contractors and vendor audits.

  5. Register employees and issue insurance numbers

Enter each eligible employee with family details so that an insurance number and e-Pehchan card are generated. Employees who already have an insurance number should be linked rather than registered again.

  6. Start contribution deposits

Generate the monthly contribution challan on the portal and pay by the due date. Match wages and days worked to payroll before submitting.

  7. Maintain records and displays

Keep registers of employees, wages and attendance, display the registration details at the workplace and be ready for inspection. Update the portal when employees join, leave or change wages.

Government fees and contribution rates

ESIC does not charge a registration fee. The ongoing cost is the contribution on wages. The rates below are the ones in force before the Code and have not been changed by the 2026 transition materials we reviewed, but confirm on the portal before payment.

ItemAmountNote
ESIC employer registrationNo government feeRegistration is online; professional charges are separate
Employer contribution3.25% of wagesLong-standing rate; verify current notification
Employee contribution0.75% of wagesEmployees with average daily wage up to ₹176 are exempt from their share; employer still pays its share
Wage ceiling for coverage₹21,000 per monthContinues until rules are finalised under the Code, per Labour Ministry FAQs

Professional charges are quoted separately after reviewing your case. Government fees are paid directly to the authority. Contribution rates and the wage ceiling are set by Government notification and may change.

How long does ESIC registration take?

With clean data, employer registration is often completed within a few working days, although ESIC does not commit to a fixed time. The slower part is usually employee onboarding, because insurance numbers depend on correct Aadhaar, date of birth and family details. Allow about a week for the employer code and another week for employee onboarding before the first payroll that includes ESI.

StageTypical time
Data and document preparation1–3 working days
Employer registration and code allotmentFew working days; subject to ESIC
Employee registration and insurance numbers1–2 weeks depending on data accuracy
First contribution depositBy the 15th of the month following the wage month

Validity & renewal

The employer code is permanent and there is no renewal. Contributions are made monthly for each wage month, and contribution periods run in two halves of the year, April to September and October to March, which determines when an employee's eligibility is tested. If your establishment closes, intimate closure through the portal after clearing dues. The OSH Central Rules also provide that a closure intimation in Form-V is shared with EPFO and ESIC, so keep the information consistent.

Compliance after registration

  • Deposit employer and employee contributions by the 15th of the month following the wage month
  • Register new employees promptly and report exits so that cover and benefits stay accurate
  • Keep the register of employees, wage records and attendance available for inspection
  • Allow employees to use their e-Pehchan card and help with claims where needed
  • Reconcile ESIC wages with PF and payroll data every month
  • Review employees who cross the ₹21,000 limit and treat them at the start of the next contribution period
  • Report employment injury or dangerous occurrence as the scheme requires and support injury claims
  • File returns and records as notified by ESIC under the Code and its rules

Common mistakes & rejection reasons

Waiting for the notified-area rule

Some employers still believe ESIC applies only in notified areas. Coverage is now pan-India under the Code, so a unit that has 10 or more employees cannot rely on its location.

Missing the hazardous-process rule

An establishment with only a few staff but one employee in a hazardous process is covered. Check the process list before assuming a small team is exempt.

Aadhaar and date-of-birth mismatches

Employee records that do not match Aadhaar are rejected during insurance number generation. Verify data at joining to avoid weeks of correction.

Applying the wrong wage base

The Code's wage definition applies from 21 November 2025. Payroll structures that exclude components that the Code treats as wages can underpay contributions.

Late deposits

Contributions paid after the due date attract interest and damages. Because ESIC benefits depend on contributions being paid, late payment can also affect employees' claims.

Not onboarding contract workers

The principal employer is responsible for ensuring that contract labour is enrolled. Collect contractor challans each month and verify the numbers.

Penalties for non-compliance

Failure to register, to pay contributions or to maintain records can lead to recovery of dues with interest and damages and prosecution under the Code on Social Security, 2020. The Code has restructured offences and penalties compared with the ESI Act, 1948, and the exact amounts and sections depend on the contravention. Because we could not verify the penalty schedule from the primary text, we do not quote figures here. Ask for a case-specific review if you have unpaid periods.

Practitioner tips

  • Register the employer and onboard employees in the same week as the PF registration. The same employee master serves both and it avoids correcting records twice.
  • Run a quarterly check of employees whose salary is close to ₹21,000. Increments pushing someone over the limit mid-period are the commonest source of wrong contributions.
  • For hazardous-process units, keep a short note of which processes and which employees are involved, so you can show coverage logic if an inspector asks.
  • Download and archive each month's challan and wage register. ESIC inspections request records for multiple past periods, and portal histories are not always easy to retrieve.
  • If you recruit through a contractor, add a clause requiring monthly ESI and PF challans as a condition of payment. It is the practical way to show you met the principal employer's duty.

ESIC Registration: frequently asked questions

Is ESIC registration mandatory?

Yes for covered establishments. Under the Code on Social Security, 2020 ESIC applies across India, is voluntary for establishments with fewer than 10 employees and is mandatory for establishments with even one employee engaged in a hazardous process. Establishments with 10 or more employees that fall in covered categories must register.

How many employees are needed for ESIC registration?

Ten or more employees for covered establishments. Below ten, coverage is voluntary, but an establishment with even one employee in a hazardous process must register. Contract workers are counted as per the Code, and the principal employer is responsible for ensuring they are covered.

What is the ESIC wage limit in 2026?

₹21,000 per month. The Labour Ministry's FAQs state that until the rules under the Code are finalised, the ₹21,000 wage notified for ESI coverage continues. A different limit, historically higher for persons with disability, can be notified, so verify the current figure before registering.

What are the ESIC contribution rates for employer and employee?

The long-standing rates are 3.25% of wages from the employer and 0.75% from the employee. Employees whose average daily wage is up to ₹176 do not pay their share, but the employer still does. These rates are set by notification, so confirm on the portal.

How do I register on the ESIC portal?

Create an employer login on the ESIC portal, fill in establishment, owner and bank details, upload documents and submit. After verification you receive a 17-digit employer code. You then register each eligible employee to generate insurance numbers and begin monthly contribution payments.

Is ESIC applicable in all states now?

Yes. The Government's 21 November 2025 release states that ESIC coverage and benefits are extended pan-India. Earlier, ESI applied only in notified areas, which is why many employers assumed they were exempt. Under the Code, location is no longer the deciding factor.

By when must ESIC contribution be paid?

By the 15th of the month following the wage month, under the long-standing rule. Confirm the due date on the portal because the Code's rules may revise timelines. Late payment attracts interest and can affect employees' benefit claims, so schedule payment early.

Can I register for ESIC if I have fewer than 10 employees?

Yes, voluntarily. The Code allows establishments below ten employees to opt in. Once registered, monthly compliance is mandatory. Small employers often opt in to offer medical and maternity cover to staff and to meet vendor requirements.

Do employees above ₹21,000 get ESIC cover?

Generally no. Employees earning above the wage limit fall outside coverage. If an employee crosses the limit during a contribution period, the long-standing practice is to continue until the end of that period, and to reassess at the start of the next. Confirm treatment under current rules.

What are the benefits of ESIC to employees?

Insured employees and their families receive medical care, cash benefit during sickness, maternity benefit for women employees, disablement benefit for employment injury and dependants' benefit after work-related death. Eligibility depends on contributions paid for the required period, so regular deposit is important.
