Licences Required to Open a Bar, Pub or Nightclub in India

Reviewed by Satyam Gupta, Company Secretary (CS) & Advocate · Last reviewed 16 October 2026

The licences required to open a bar in India start with one approval that decides whether the venue can exist at all: the State excise licence to serve alcohol. Around it sit an FSSAI registration or licence for any food and drink served, a municipal trade licence, fire clearance, signage permission, GST registration and labour registrations. Because excise policy is made State by State and revised often, a bar or club is the least portable business to plan from a generic checklist. This roadmap shows the sequence, central and State roles, and what a running venue owes each year.

Licences and registrations to plan for

  • Before lease or fit-out
    Building approval and permitted-use check

A bar must sit in premises whose sanctioned use allows it. Mixed-use or residential buildings and conversions need the development authority's approval, which excise and fire officers later check.

  • Before opening
    GST registration

Needed for food and service supplies once you cross the threshold, and for tax invoices. Alcohol for human consumption is outside GST, so excise duty and State VAT sit separately; check how your State treats it.

  • Before fit-out is finalised
    Liquor licence (excise)

The core licence for a bar or club. It is issued by the State Excise Department under the State's excise law and policy, usually annually, with fees tiered by seating, zone or category.

  • Before opening
    FSSAI registration or licence

Any food served, including bar snacks and mixers prepared on site, needs FSSAI coverage. From 1 April 2026 the tiers are registration up to ₹1.5 crore turnover, State licence to ₹50 crore and Central licence above.

  • Before opening
    Municipal health / trade licence

Local bodies license eating and drinking places for public health. Rules, fees and validity differ by municipality.

  • Before opening (Delhi)
    Eating house licence (Delhi) status

Delhi Police's eating house licence was withdrawn in June 2025 as reported. Read this page for what to check instead, since many older bar checklists still list it.

  • Before opening
    Fire NOC

Crowded, low-light venues with sound systems, décor and kitchens face close scrutiny. Exits, occupancy and fire systems are checked under the State's fire Act.

  • Before display
    Signage / advertisement permission

Fascia boards and hoardings can need local body permission. Alcohol advertising has its own restrictions, so avoid any liquor brand display until you have checked the rules.

  • Before hiring
    Shop and establishment registration

State labour registration for staff, including rules on working hours and night work that matter for late-opening venues.

  • On hiring
    EPF registration

Applies once the headcount crosses the coverage threshold. Large clubs and multi-outlet groups usually do.

  • On hiring
    ESIC registration

For eligible staff under the headcount and wage ceiling.

Why the liquor licence leads the roadmap

In most businesses a licence follows the premises. In a bar the licence may decide whether the premises are worth taking. Excise authorities set eligibility by zone, seating, distance from sensitive places and the State's policy for that year, and a venue that fails those tests cannot be fixed with a good fit-out.

Our liquor licence page records that the annual licence fee is set by State policy, is often tiered by seating, zone or hotel category and runs into lakhs of rupees. Delhi's renewal circular for 2026-27 shows fee tiers by seating, a 10 per cent increase and validity from 1 April 2026 to 31 March 2027 under section 13(1) of the Delhi Excise Act, 2009. We do not quote the tier amounts because the table could not be read reliably.

The roadmap: what to apply for and in what order

Approach the excise rules before you sign the lease. Everything after that is about aligning the venue to what the excise officer, fire officer and municipal inspector will each check on the same drawing.

A workable sequence for a new bar or club is below.

  • Read the State's current excise policy for your category, and confirm the premises' zone, seating capacity and distance rules before committing to a lease.
  • Confirm the sanctioned use of the building and get approvals for any change of use or alteration.
  • Set up the entity, PAN and GST registration.
  • Apply for the liquor licence on the State excise portal, with the layout, ownership or lease papers, entity documents and any No Objection the State requires.
  • Apply for FSSAI for the food and drink side, and for the municipal licence.
  • Apply for the fire NOC on the final layout, including exits, occupancy and systems.
  • Register under the shops and establishments law, then EPF and ESIC if you cross the thresholds.
  • Obtain signage permission and verify the music and performance permissions the venue needs before the first event.

State differences: Delhi, Uttar Pradesh and Haryana

Delhi: Liquor is under the Delhi Excise Department through its portal, with licences running on the financial year. Delhi's replacement excise policy was reported as still being finalised, so recheck before you plan a launch. Fire clearance is with the Delhi Fire Service and municipal licences with MCD or NDMC.

Uttar Pradesh: The Excise Department administers licences under the UP excise policy, with a District Bar Committee reported in the approval process. Seating, floor area and fee figures reported in secondary summaries of the 2025-26 policy have not been verified for the current year, so use the current policy document.

Haryana: The Haryana Excise Policy for 2025-27 runs from 12 June 2025 to 31 March 2027 as reported. Bar categories, fees and statute names need to be read from the Excise and Taxation Department's current notifications before you file.

Police, performance and music permissions

Earlier checklists often include a police eating house licence in Delhi, but that licence was withdrawn in June 2025 as reported. For late-night hours, DJs, live bands and dance floors, some States and cities impose separate permissions on timings, entertainment or noise. We could not verify a universal police or performance licence across Delhi, UP and Haryana, so ask the excise office and your local police station what applies to your venue category.

Playing recorded or live music for customers is also a public performance of copyrighted works, and music rights owners license that use. Confirm the current licence position and tariffs with the relevant copyright societies. Noise limits under the Noise Pollution Rules also apply to amplified sound, and State boards and police enforce them.

Recurring compliance calendar

A bar is audited more than most businesses, and the excise licence can be suspended or cancelled for breaches. Keep each date in a calendar and give one person ownership of it.

  • Annually: liquor licence renewal ahead of the 31 March expiry in Delhi (other States run to their own policy years), municipal licence renewal as per your body, FSSAI annual fee (and any return your category requires), and fire NOC renewal as per State rules.
  • Monthly: GST returns, TDS deposit, PF and ESIC contributions, and any excise stock and sale returns the State requires.
  • Ongoing: maintain stock registers, purchase records from authorised sources, price and age-restriction displays and any CCTV or entry-control conditions attached to the licence.
  • On change: report changes in partners, directors, layout, seating or manager to the excise authority as its rules require, before acting on them.

Common pitfalls we see

  • Signing a lease before reading the excise eligibility rules. A site that does not qualify cannot be fixed afterwards.
  • Treating FSSAI and the liquor licence as one. They are separate approvals from separate authorities with separate renewals.
  • A layout that changes between the excise drawing, the fire drawing and the municipal application. Officers compare them.
  • Opening on a pending application. Serving alcohol before the licence is issued is an excise offence.
  • Relying on an old Delhi checklist that lists the police eating house licence.
  • Missing the policy window. If an application cycle closes, the next may be a year away.

Frequently asked questions

Which licences are required to open a bar in India?

The State excise liquor licence is central. Alongside it you generally need FSSAI registration or licence, a municipal trade or health licence, a fire NOC, signage permission, GST registration and labour registrations. Policy, fees and eligibility are decided State by State, so confirm them before you sign a lease.

Who issues the liquor licence for a bar?

The State Excise Department issues it under the State's excise law and policy. Our liquor licence page lists the Delhi Excise Department, the UP Excise Department with a District Bar Committee, and the Haryana Excise and Taxation Department. Applications are usually made on the State's excise portal.

How much does a bar licence cost?

There is no national fee. Annual licence fees are set by each State's policy, are often tiered by seating, zone or category, and can run into lakhs of rupees. Delhi's 2026-27 renewal circular shows seating-based tiers with a 10 per cent increase. Check the current notification for your State.

Is FSSAI required for a bar?

Yes, if you serve food or prepare any food or drink on the premises. The tier depends on turnover and Kind of Business, with registration up to ₹1.5 crore, State licence up to ₹50 crore and Central licence above that from 1 April 2026. Check FoSCoS for your category.

Do I need a police licence for a bar or club in Delhi?

Delhi Police's eating house licence was withdrawn in June 2025, as reported. We could not verify a universal police licence for performance or late hours across Delhi, UP and Haryana, so ask the excise office and the local police station what applies to your venue.

Is a separate licence needed for live music or DJ nights?

Music rights owners license public performance of their works, and some States or cities may regulate entertainment, hours or noise separately. We have not verified current tariffs or a single permission that covers all States. Confirm with the relevant societies and local authorities.

Can I open a bar in a residential or mixed-use building?

Usually not without the competent authority's approval. Excise and municipal rules check the sanctioned use and zone of the building, and distance rules from sensitive places may apply. Confirm these on the State's policy before taking the premises.

How long does it take to get a bar licence?

There is no fixed period. Timelines depend on the State's policy window, inspection and committee approval, and a licence can wait for the next cycle if the window is closed. Plan fit-out and hiring around the licence date, not the reverse.

Does a bar need to renew its licences every year?

Liquor licences are generally annual, and Delhi's run from 1 April to 31 March. Municipal licences are usually annual too, while FSSAI approvals are perpetual from April 2026 subject to annual fee and compliance. Fire NOC renewal follows State rules.
