Opening a clinic in India means more than a medical degree. Health is a state subject, so the licences required to open a clinic depend on your state, the size of the facility, whether it has beds and whether it runs a pharmacy, laboratory or imaging service. Most clinics need professional and establishment registration, biomedical waste authorisation, local trade and shop registrations, and fire clearance where the building rules require it. This roadmap sets out the order, the central and state split, and what a running clinic must keep up.
Licences and registrations to plan for
- Before taking premisesBuilding plan approval and premises use
A nursing home or diagnostic centre should sit in a building with approved use and structure. Check the permitted use of the floor before signing a lease.
- Before patients are seenClinic or nursing home registration
The state health department registers clinical establishments under the Clinical Establishments Act where it has been adopted, or under older state laws such as the Delhi Nursing Homes Registration Act, 1953 in the NCT of Delhi.
- Before operationBiomedical waste authorisation
Every occupier handling biomedical waste needs authorisation from the State Pollution Control Board under Rule 10 of the 2016 Rules, usually with a tie-up with an authorised common treatment facility.
- Before occupationFire NOC
Hospitals and nursing homes are usually treated as higher-risk occupancies, and the building height, floor area and bed count decide whether a fire clearance is required under the state fire law.
- Before pharmacy opensDrug licence for an in-house pharmacy
A retail pharmacy needs a retail sale licence and a registered pharmacist. A doctor dispensing to own patients should check the state rules before stocking medicines.
- If you trade in devicesMedical device rules, where relevant
Clinics that use devices do not normally register them. The rules matter if you manufacture, import or sell devices, so check the Medical Devices Rules before you branch into that.
- On starting operationsShops and establishments registration
Many states treat a clinic with staff as an establishment, so it registers with the state labour department. Check whether your state exempts professionals or small units.
- Before openingTrade licence from the local body
Municipal bodies license commercial premises under their own rules. Whether a clinic needs one depends on the local body, so ask before you open.
- Before opening, if applicableHealth trade licence
Some municipal bodies include medical or diagnostic premises in their health licensing categories. Confirm if your city has such a category.
- Before first taxable supplyGST registration
Health care services by a clinical establishment are exempt from GST under the exemption notification, but pharmacy sales and non-exempt services are not. Confirm which parts of your revenue are taxable.
- On hiringEPF and ESIC
Larger nursing homes and diagnostic chains cross the coverage thresholds, while very small clinics may not. Check on each hire.
- If AYUSH practiceAYUSH approvals
AYUSH practitioners and AYUSH drug makers follow separate registration and licensing rules, so confirm the system and the state before assuming the allopathic route.
Why clinic compliance differs by state
The Clinical Establishments (Registration and Regulation) Act, 2010 applies only in states and Union Territories that adopted it. The Ministry of Health site indicates that Uttar Pradesh and Haryana are among them. Delhi is different: the Delhi government has told the courts that the Central Act does not apply in the NCT and that the Delhi Nursing Homes Registration Act, 1953 governs.
That is why the first practical step is to ask your district Chief Medical Officer, or the Delhi Directorate of Health Services, which Act, which form and which standards apply to your facility. Fees, validity and the standards for rooms, equipment and staff differ by state and by whether the clinic has beds. Our clinic registration page flags what we could not verify.
The roadmap: order of approvals
The usual order for a new clinic or nursing home is below. A single-practitioner clinic without beds will have a shorter list.
- Confirm the practitioner's registration with the State Medical Council or the National Medical Commission register, and the registration of any nurses, pharmacists and technicians you hire.
- Choose the premises and check land use, building approval and the lift, ramp and fire exit requirements for the category you plan.
- Apply for registration under the state clinical establishment or nursing home law, with the layout, staff list and equipment details.
- Apply for biomedical waste authorisation from the pollution board and sign an agreement with an authorised common biomedical waste treatment facility.
- Obtain fire NOC if your building class needs it, and shop or trade registrations from the labour department and the local body.
- If you plan a pharmacy, apply separately for the sale licence. If you plan X-ray or imaging, check the Atomic Energy Regulatory Board licensing and the radiation safety officer requirements.
- If you plan ultrasound or genetic counselling, register under the PCPNDT Act as described below before offering the service.
- Register for GST if you have taxable supplies such as a pharmacy, and complete PF and ESIC registration as staff numbers grow.
Services that carry their own approvals
Pharmacy: A retail pharmacy needs a licence under the Drugs Rules, 1945, a registered pharmacist and suitable premises. The state drugs control department inspects the premises and the pharmacist's registration. Our drug licence page covers forms and areas.
Imaging and X-ray: Diagnostic radiology is regulated by the Atomic Energy Regulatory Board, which requires registration and licensing of X-ray equipment and a qualified radiation safety officer. We could not verify the current portal steps, so check the AERB website.
Ultrasound and genetic services: The Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 requires clinics performing prenatal ultrasound or genetic counselling to register with the appropriate authority and maintain prescribed records. Disclosure of fetal sex is prohibited. If you do not offer these services, this Act does not apply to you.
Laboratories and blood banks: These have separate licensing and standards that go beyond this roadmap.
Biomedical waste: the approval clinics forget
Every clinic, including a single doctor's room, generates syringes, dressings or sharps and is an occupier under the Bio-Medical Waste Management Rules, 2016. Authorisation comes from the State Pollution Control Board in Form II. For non-bedded facilities our service page records a one-time authorisation, while bedded facilities follow the consent cycle. The board also expects colour-coded segregation, a register of waste and an annual report.
Fees differ by board. As one example, DPCC lists a yearly charge for private clinics, which we show on the service page. Check your board's current schedule.
Delhi, Uttar Pradesh and Haryana: where applications go
Delhi: Nursing homes register with the Directorate of Health Services under the Delhi Nursing Homes Registration Act, 1953. We have not verified the current process for bedless clinics or any newer law, so ask the Directorate before you file. Pollution authorisation comes from DPCC, fire clearance from the Delhi Fire Service and trade licensing from the municipal corporation.
Uttar Pradesh: The Clinical Establishments Act is in force, and registration goes through the district Chief Medical Officer. UPPCB handles biomedical waste, and the UP Fire and Emergency Services handles fire clearance.
Haryana: The Clinical Establishments Act applies and the state health department registers facilities. HSPCB issues biomedical waste authorisation, and Haryana fire services give clearance for buildings above the state thresholds.
Each office has its own forms and fee schedule, so verify them on the official site.
Recurring compliance for a running clinic
- Registration renewal: keep to the validity and renewal date under your state registration, and report changes in doctors, services or beds.
- Biomedical waste: daily records, an annual report to the pollution board and renewal of authorisation as per your board's rules.
- Fire safety: serviceable extinguishers, fire drill records and renewal of the fire NOC where the state requires it.
- Pharmacy: pharmacist on duty, purchase and sale invoices with batch numbers, and the licence retention fee on the cycle stated by the Rules.
- Patient records, display of registration, rate lists and grievance mechanisms as the state rules prescribe.
- Taxes and labour: GST for taxable supplies, TDS, PF and ESIC returns, and professional tax where your state levies it.
Pitfalls that delay clinic approvals
- Starting patient care before registration. Many state laws penalise operating an unregistered clinical establishment.
- Assuming a single-doctor room is exempt from biomedical waste rules. It is not.
- Leasing premises in a residential building without checking use conditions, which blocks fire and trade clearances.
- Hiring pharmacists or technicians whose registration is not current.
- Treating the Delhi position as the same as the Central Act. Delhi follows its 1953 Act, so a Central Act checklist can mislead.
Frequently asked questions
Do I need a licence to open a small clinic in India?
Yes, in most cases you need registration under your state's clinical establishment or nursing home law, biomedical waste authorisation, and local shop or trade registrations. Exact requirements depend on the state and on whether the clinic has beds, so confirm with the district health office.
Does the Clinical Establishments Act apply in Delhi?
According to a Delhi government affidavit reported in the press, the Central Act does not apply in the NCT and the Delhi Nursing Homes Registration Act, 1953 governs. Confirm the current position with the Delhi Directorate of Health Services before filing.
Is biomedical waste authorisation compulsory for a clinic?
Yes. The Bio-Medical Waste Management Rules, 2016 require every occupier who generates such waste to obtain authorisation from the State Pollution Control Board. A single-doctor clinic is covered because syringes and dressings count as biomedical waste.
Can a doctor sell medicines from the clinic?
Retail sale of medicines needs a sale licence and a registered pharmacist under the Drugs Rules, 1945. Whether a doctor may dispense to their own patients without one depends on specific rule exceptions, so ask your state drugs control office before stocking.
Is GST charged on doctor consultation?
Health care services by a clinical establishment or authorised medical practitioner are exempt under the GST exemption notification, but pharmacy sales and some ancillary services are not. Check the notification wording for your specific supplies.
Do I need a fire NOC for a clinic?
It depends on the building type, height and floor area under your state's fire law. Nursing homes and hospitals usually face stricter rules than a small clinic, so ask the state fire service or check its thresholds.
What is PCPNDT registration?
It is registration under the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994 for clinics that perform prenatal ultrasound or genetic counselling. Sex determination is prohibited. If you do not offer these services, you do not need it.
Is a trade licence required for a clinic?
That depends on the municipal body. Some treat clinics and diagnostic centres under health or general trade licensing, others do not. Ask your municipal corporation or nagar palika before opening.
How long does clinic registration take?
There is no single national period. It depends on the state, the district office, inspection and whether provisional registration is available. Plan for the inspection and avoid committing to an opening date until you have the certificate.
