Factory Licence in Haryana

Navigate Haryana's in-between phase: the OSH Code is in force, Haryana's own rules are still draft, and the old Punjab-based rules and auto-renewal order still run your licence.

Reviewed by Satyam Gupta, Company Secretary (CS) & Advocate · Last reviewed 16 October 2026

A factory licence in Haryana is issued by the Labour Department, headed by the Labour Commissioner-cum-Chief Inspector of Factories, to occupiers of manufacturing units in the state. Haryana is the least settled of the three states we work in: it has never framed a full set of factory rules of its own and has operated under the Punjab Factories Rules, 1952, and its draft Haryana OSH Rules, 2026 were still awaiting final notification at our last review. This page explains what that means for a unit in Gurugram, Faridabad, Sonipat, Panipat, Bahadurgarh or any other Haryana industrial belt, and where the single-window and renewal facilities help.

Governing lawOccupational Safety, Health and Working Conditions Code, 2020 (in force from 21 Nov 2025); Punjab Factories Rules, 1952 as applied in Haryana continue until final Haryana OSH Rules are notified

When a Haryana unit needs a factory licence

Under section 2(1)(w) of the OSH Code, premises are a factory where 20 or more workers use power, or 40 or more work without power, on any day in the preceding twelve months. The older Haryana practice applied the Factories Act limits of 10 and 20. Count workers across all shifts, and include contract workers engaged in the process.

Units that fall below the new thresholds are not factories but may still be establishments with their own registration duty once Haryana's rules are final. Do not surrender an existing licence on the strength of the higher threshold without checking your peak-day headcount and the state portal's current position.

  • Manufacturing and job-work units in HSIIDC industrial estates and IMTs such as Manesar, Kundli, Rai, Faridabad and Bahadurgarh
  • Textile, auto component, steel re-rolling, food processing and engineering units around Panipat, Yamunanagar, Ambala and Rohtak
  • Existing licensees changing occupier, name, address, maximum horsepower or maximum workers, which requires amendment and not renewal
  • Units seeking 5-year or 10-year auto-renewal after a stable run of unchanged particulars

Auto-renewal for 5 or 10 years: a genuinely Haryana feature

Haryana's Labour Department issued an order allowing auto-renewal of factory licences under Rule 10 of the Punjab Factories Rules, 1952. The occupier can renew for five or ten years by paying five or ten times the annual fee through E-GRAS on the hrylabour.gov.in site, provided there is no change in the particulars of the licence.

That condition matters. If the occupier, factory name, address, maximum horsepower or maximum number of workers has changed, you must file an amendment first. Many Haryana renewals stall because the electricity load has grown since the last licence and nobody amended the horsepower.

We read this order from a compliance database copy of the Haryana notification (order No. 2/22/2020-2Lab), so confirm on the portal that it has not been replaced by newer instructions.

What the draft Haryana OSH Rules 2026 propose

The draft is useful for planning, even though it is not yet law. It defines the portal as the Labour Department's website, requires establishment registration electronically in Form-4, and says the certificate in Form-5 is issued within seven days or the establishment is deemed registered. Already-registered establishments would update their particulars within four months of the Code's commencement under the draft.

The proposed registration fee is a table by employee count: ₹1,000 up to 20 employees, ₹2,000 for 21 to 50, ₹3,000 for 51 to 100, rising to ₹50,000 above 5,000, with a 25% late fee. For plans, the draft requires electronic application in Form-26 and approval or rejection within thirty days, failing which the plans are deemed approved. A stability certificate in Form-28 follows the same 30-day deemed approach.

As we read the draft, general factory operation is governed by registration and plan approval, and the licence rules in the extract we reviewed concern beedi and cigar premises. Treat all of this as proposed until the final notification appears.

Single window: HEPC, Invest Haryana and the Right to Business law

Haryana's investment facilitation body is the Haryana Enterprises Promotion Centre (HEPC), set up under the 2016 notification creating the Haryana Enterprises Promotion Board. District-level clearance committees headed by the Deputy Commissioner handle projects up to ₹10 crore, and the Labour Department is among the departments covered by the single window. The Invest Haryana single-window portal is where project clearances are tracked.

In September 2026 Haryana's Right to Business law was reported as passed by the Vidhan Sabha on 1 September and notified on 18 September. It lets new and expanding manufacturing MSMEs seek a Certificate of In-Principle Approval from the District Nodal Agency within 15 working days, with a 36-month protected window for the regular approvals. One report places pollution consent and fire NOC inside its schedule but says the Labour Department entry is shop registration, not the factory licence. Another source treated the measure as a Bill gazetted on 31 August 2026 and not yet confirmed as an Act. Because sources conflict and the procedure is new, do not skip the factory licence on the strength of an in-principle certificate.

Documents and practical tips for Haryana filings

The portal expects scanned uploads. The core set is similar to other states, but Haryana scrutiny leans heavily on consistency between your papers and the load and headcount you declare.

  • Occupier's identity proof and authority or board resolution; partnership deed or incorporation certificate
  • Ownership proof or registered lease, and allotment letter from HSIIDC or the local authority for industrial estate plots
  • Approved building plan or site layout and details of manufacturing process, raw materials and machinery with horsepower
  • Latest electricity bill showing sanctioned load, from UHBVN or DHBVN
  • Pollution board consent or white-category position where applicable
  • E-GRAS challan details for the fee
  • Keep the maximum horsepower and maximum workers in the application equal to your actual peak figures, since a mismatch blocks auto-renewal
  • Diarise the renewal date and the annual and half-yearly returns under the existing Haryana procedure until the new rules replace them

Step-by-step process

  1. Confirm applicability under the OSH Code

Check peak-day headcount and power use against the 20 and 40 worker thresholds before deciding between licence, amendment or surrender.

  2. Settle location and approvals

Confirm the plot is in a permitted industrial area and line up HSPCB consent and fire papers that inspectors will ask about.

  3. Log in to the Labour Department portal

Register the occupier on hrylabour.gov.in and open the factory licence service; project-stage clearances can be tracked through Invest Haryana and HEPC.

  4. Fill factory, occupier and load details

Enter horsepower, maximum workers, process and manager details and upload the documents.

  5. Pay the fee through E-GRAS

Generate the challan and pay online; for a 5 or 10-year auto-renewal pay the annual fee multiplied by the years.

  6. Answer queries and inspection

Reply to scrutiny queries, and facilitate the factory inspector's visit for new licences or amendments.

  7. Record validity and plan for the final rules

Note the validity date and watch for final Haryana OSH Rules, which may change forms, fees and registration steps.

Frequently asked questions

Are Haryana's OSH rules final?

Not at our last review. Haryana published draft Haryana OSH and Working Conditions Rules, 2026 on 4 May 2026 and invited objections until 19 June 2026, but we found no final notification. The OSH Code applies from 21 November 2025, while the existing Punjab Factories Rules-based procedure continues in the interim. Check the Labour Department site before filing.

Can I renew my Haryana factory licence for 10 years?

Yes, under Haryana's auto-renewal order you can renew for 5 or 10 years by paying 5 or 10 times the annual fee through E-GRAS, but only if there is no change in the licence particulars such as occupier, name, address, maximum horsepower or maximum workers. If anything changed, amend the licence first.

Which law governed Haryana factories before the OSH Code?

The Factories Act, 1948 read with the Punjab Factories Rules, 1952, because Haryana did not frame its own full set of factory rules. The OSH Code replaced the Act on 21 November 2025, and the old rules are expected to continue only until Haryana's final OSH Rules are notified.

Does the Haryana Right to Business law replace the factory licence?

No. It is described as a route to a Certificate of In-Principle Approval for manufacturing MSMEs, decided in 15 working days with a protected window for regular approvals. It does not create a deemed factory licence, and reports differ on whether it is fully in force. Keep applying for the licence through the Labour Department.

Who is the Chief Inspector of Factories in Haryana?

The Labour Commissioner of Haryana acts as the Chief Inspector of Factories, and the draft OSH rules give the office as the Labour Commissioner-cum-Chief Inspector of Factories at the 30 Bays Building, Sector 17-B, Chandigarh. District-level factory inspectors handle scrutiny and inspections in the field.

How many workers make a unit a factory in Haryana?

Under the OSH Code, 20 or more workers where power is used, or 40 or more without power, on any day in the previous twelve months. Haryana earlier followed the 10 and 20 limits. Smaller units may still be establishments needing registration once the final state rules are notified.

Where do I pay the Haryana factory licence fee?

Through E-GRAS, the state's government receipts portal, linked from the Labour Department's site. The auto-renewal order specifically mentions E-GRAS for the multiplied fee. The draft OSH rules also propose online payment through the departmental portal for the new registration fee.

Do I need HSPCB consent before a Haryana factory licence?

Where your activity needs consent, expect it to be asked for. Haryana's pollution board bars industries from residential areas and routes consent through the HEPC portal, and inspectors usually check consent status. Apply for consent and the labour file in step with each other to avoid one stalling the other.
