RERA Agent Registration for Property Dealers and Brokers

Agent registration filed with the right state authority, with the books, quarterly details and renewal calendar that keep the certificate valid.

  • Individual, firm and company filings handled
  • Right authority chosen: Delhi, UP or Haryana
  • Quarterly transaction details tracked
  • Renewal reminders before the 5-year expiry

RERA agent registration is the registration that a real estate agent, broker or property dealer must obtain from the state Real Estate Regulatory Authority under Section 9 of the Real Estate (Regulation and Development) Act, 2016 before facilitating the sale or purchase of any plot, apartment or building in a real estate project that is registered or required to be registered. If you work as an individual broker, a firm or a company in this business, you need it.

What is RERA agent registration?

The RERA Act defines a real estate agent as a person who, for a fee or commission, negotiates or acts on behalf of another person in a transaction of transfer of a plot, apartment or building in a real estate project, including through listing, introduction or advertising. Section 9(1) says no agent may facilitate such sale or purchase without being registered with the authority.

The obligations of registered agents are set in Section 10. They include not facilitating any sale or purchase in a project that needs registration but is not registered, maintaining and preserving books, records and documents as prescribed by the rules, not indulging in unfair trade practices, and giving the buyer the information and documents they are entitled to at the time of booking. Haryana RERA's agent certificates, for example, also require agents to attend authority training, to report change of address and to upload quarterly transaction details within a stated period after each quarter ends.

Agent registration is separate from the promoter's RERA project registration. A promoter registers the project; the agent registers in his or her own name or entity name. Registration is address-specific in some states, so a change of office needs prior intimation to the authority.

Each state frames its own forms, fee schedule and online process under its Rules. The Act sets the framework, but you should always follow the current procedure on the authority's portal for Delhi, Uttar Pradesh or Haryana.

Who needs RERA agent registration?

Anyone who earns a fee or commission by facilitating sales or purchases in real estate projects falls in the net. Typical cases:

  • Individual property brokers and dealers working from an office or from home
  • Real estate brokerage firms, partnerships and LLPs
  • Companies in the business of property sales, channel partner and sourcing firms
  • Channel partners and sales associates appointed by builders to sell units in registered projects
  • Online property advertising or lead-generation businesses that negotiate or facilitate transactions as agents
  • Agents who also work on resale of units in projects that are registered or required to be registered

Benefits of RERA Agent Registration

Lawful right to earn commission

Registered agents can work with promoters and buyers openly. Many builders and banks ask for the RERA agent number before empanelment or payout.

Credibility with buyers

The registration number appears in the authority's agent listing. Buyers can verify it, which helps trust in a field where informal dealing is common.

Protection from penalty

Working without registration exposes you to a penalty under Section 62. Registration removes this exposure as long as you comply with Section 10.

Access to builder channel programmes

Developers commonly require a valid agent registration before onboarding channel partners and releasing brokerage.

Eligibility and applicability

The Act does not set an educational qualification for agents, but the state rules prescribe the application format and supporting papers. Key points to check:

  • Applicant can be an individual, proprietorship, partnership, LLP or company, depending on the state format
  • A fixed business address with proof (ownership or rent agreement) is generally required, and in some states the certificate is valid only for that address
  • Identity, address and PAN of the applicant, partners or directors are needed
  • Each state may require a declaration that no adverse order exists against the applicant; check the state form for exact wording
  • If you operate in more than one state you may need a separate registration in each state where you facilitate sales, because each authority registers agents for its own territory

Documents required

Identity and entity documents

  • PAN card of the individual or the entity and Aadhaar or other ID proof
  • For firms and companies: partnership deed, LLP agreement or certificate of incorporation, with the list of partners or directors
  • Passport-size photograph of the applicant or authorised signatory
  • Authority letter or board resolution for the authorised signatory

Address documents

  • Proof of business address such as ownership document or registered rent agreement
  • Utility bill or NOC from the owner of the premises, as the state format requires

Bank and declaration documents

  • Cancelled cheque or bank account details of the business
  • Affidavit or declaration in the format prescribed by the state authority
  • Details of any past or pending proceedings as asked in the form
  • Digital signature where the portal requires it for submission

Step-by-step RERA agent registration process

Portal screens differ in UP-RERA, Haryana RERA and Delhi RERA, but the sequence is broadly similar.

  1. Choose the correct authority

Select the authority for the state where you work and where your office is located. For NCR agents, Delhi, Uttar Pradesh and the Gurugram or Panchkula authorities in Haryana are separate and need separate registrations if you work in each.

  2. Register on the portal

Create an agent account with PAN, mobile number and email, and verify them as the portal requires.

  3. Fill the agent application

Enter the applicant type, office address, partner or director details and bank details. Keep the spelling of names and addresses the same as in the PAN and address proofs.

  4. Upload documents and declaration

Upload identity, address and entity papers and the prescribed affidavit or declaration. Make sure scans are legible and each file is within the portal's size limit.

  5. Pay the fee online

Pay the state's agent registration fee through the portal. Keep the payment acknowledgement.

  6. Respond to any query

The authority may ask for clarification or better documents. Under Section 9, the authority should decide within 30 days of a complete application, but queries pause that clock in practice.

  7. Receive the certificate

On approval you receive a registration number and certificate. Read the conditions printed on it, for example address validity, record keeping and quarterly reporting.

  8. Start compliance

Quote the number in advertisements and agreements, keep books under the state rule, and file transaction details at the intervals your authority requires.

Government fees

The agent registration fee is fixed by each state's rules and generally differs between individuals and firms or companies. Renewal has its own fee. We have not quoted figures here because they vary by state and are revised from time to time; confirm the current schedule on the portal before applying.

Professional charges are quoted separately after reviewing your case. Government fees are paid directly to the authority.

How long does it take?

The Act directs the authority to grant or refuse registration within 30 days of receiving the application, and refusal must be with reasons. In practice, applications with clear documents and a verified address move faster. Queries on address proof and entity documents are the most common cause of delay.

Validity and renewal

Registration is valid for five years from the date of grant, as shown on Haryana RERA agent certificates, and is renewable under the Act and the state rules. Apply for renewal before the expiry date and pay the renewal fee, as working with an expired registration is treated as working without registration. A change of office address should be reported to the authority first, as some authorities state that the certificate becomes invalid for the old address.

Compliance after registration

  • Show the RERA agent registration number on visiting cards, websites, advertisements and brokerage agreements
  • Facilitate sales only in projects that are RERA-registered or exempt; check the project's registration number on the authority portal before listing
  • Maintain books of account, records and documents as required by the state rules, and preserve them for the period prescribed
  • Upload quarterly transaction details where the authority requires it (Haryana RERA certificates state within 15 days after the quarter ends)
  • Attend training sessions organised by the authority when called
  • Do not use unfair trade practices such as misleading advertising or false statements about carpet area, price or approvals (Section 10)
  • Give buyers the information and documents they are entitled to at the time of booking
  • Renew before expiry and report address changes to the authority

Common mistakes and rejection reasons

Weak address proof

Unregistered rent agreements, expired agreements or mismatched owner details cause queries. Use a valid ownership proof or registered rent agreement with an NOC.

Applying to the wrong authority

Agents working in Gurugram and Noida cannot rely on one state's registration for the other. Pick the authority per territory.

Name and PAN mismatch

Different spellings across PAN, Aadhaar and entity papers lead to rejection or a query.

Listing unregistered projects

Facilitating sale in a project that requires RERA registration but has none breaches Section 10 even if you are registered yourself.

Ignoring quarterly details and renewal

Many agents file once and forget. Missing quarterly uploads or renewal dates can attract notices and penalty.

Penalties for non-compliance

Section 62 of the RERA Act is titled penalty for non-registration and contravention under Sections 9 and 10. If an agent fails to comply with Section 9 or 10, the penalty is ten thousand rupees for each day the default continues, which may cumulatively extend up to five per cent of the cost of the plot, apartment or building of the project for which the agent facilitated the sale or purchase, as the authority determines. The authority can also revoke registration for breach of conditions.

Practitioner tips

  • Register from the premises you will actually use for a long period. Since some authorities tie the certificate to the registered address, a casual rental invites an address-change procedure within months.
  • Before listing any project, search its registration number on the authority's project page and note it in your records. This single habit prevents the most common Section 10 breach.
  • Diary the quarter-end uploads and the five-year renewal on the day you receive the certificate. Authorities are stricter on missed reporting than on small data errors.
  • If your firm sells in both Delhi and Haryana or UP, treat each state as a separate registration with its own login, address proof and compliance calendar.

RERA Agent Registration: frequently asked questions

Is RERA registration mandatory for property agents?

Yes. Section 9 of the RERA Act says no real estate agent can facilitate the sale or purchase of a plot, apartment or building in a real estate project without registering with the authority. This applies to individuals, firms and companies working for a fee or commission.

What is the validity of RERA agent registration?

Haryana RERA agent certificates state a validity of five years from registration, renewable under the Act and rules. Other states follow the same framework, but check your certificate and state rules for the exact period and renewal process.

What documents are required for RERA agent registration?

Usually PAN and ID proof, address proof of the business premises, entity documents for a firm or company, bank details, a photograph and the prescribed affidavit or declaration. The exact list is in the state authority's checklist, so check it before filing.

What is the penalty for working as an agent without RERA registration?

Section 62 provides a penalty of Rs 10,000 for each day of default, which can cumulatively go up to five per cent of the cost of the plot, apartment or building for which the agent facilitated the sale or purchase. The authority determines the final amount.

Can I use one RERA agent registration in all states?

Generally no. Each state authority registers agents for its own territory, and agents who work in several states usually need a registration with each relevant authority. NCR agents should check Delhi, UP and the two Haryana authorities separately.

Is the agent registration number required in advertisements?

Authorities expect agents to display their registration number on advertisements and documents, and projects must also carry their own RERA numbers. Check your state's rules and the conditions printed on your certificate for the exact requirement.

Do I have to file returns as a RERA agent?

It depends on the state. Haryana RERA agent certificates require quarterly transaction details to be uploaded within 15 days after the quarter ends. Other authorities have their own requirements, so check the conditions of your registration.

Can an agent registered under RERA sell unregistered projects?

No. Section 10 says an agent must not facilitate sale or purchase in a real estate project or part of it that is required to be registered but is not registered. Always verify the project's RERA number before listing it.

What happens if I change my office address?

Inform the authority before changing. Haryana RERA certificates state that they are valid only for the address listed and become invalid if a change of business address is not notified. Other authorities may have similar rules.
