BOCW registration is the registration of an establishment that carries on building or other construction work, so that it can lawfully employ construction workers and comply with their safety, welfare and cess obligations. The Building and Other Construction Workers Act, 1996 has been subsumed into the Occupational Safety, Health and Working Conditions Code, 2020, and the related cess law into the Code on Social Security, 2020, both in force from 21 November 2025. This page explains what registration means today, how the cess works and what to do for each project.
What is BOCW registration?
For almost three decades the BOCW Act, 1996 and its Central and State rules regulated employment and service conditions of construction workers, with a separate Cess Act funding State welfare boards. From 21 November 2025, the OSH Code absorbed the BOCW Act and the Code on Social Security absorbed the Cess Act. Existing registrations, rules and welfare schemes continue during the transition under the savings provisions, according to the Government's announcement on the Codes.
Under the OSH Code, an establishment is generally a place where 10 or more workers are employed, and building or other construction work is defined to exclude work related to a factory or mine. The Code excludes construction of one's own residence where the total cost does not exceed ₹50 lakh or a higher notified amount. Registration is electronic, with a time limit for decision and deemed registration if the authority does not act.
The OSH (Central) Rules, 2026 notified on 8 May 2026 as G.S.R. 345(E) say that registration is applied for in Form-I and the certificate is issued in Form-III within 7 days, failing which it is generated automatically. Rule 4 requires a notice of commencement or cessation of construction work in Form-VI within 30 days, according to the secondary reproductions we reviewed. The rules also supersede the BOCW Central Rules, 1998, with a savings clause. State-sphere projects follow State OSH rules once these are final, and legacy State BOCW rules continue until then.
Cess is a separate, linked obligation. It funds the welfare board that gives benefits to registered construction workers, and it is payable by the employer on the cost of construction.
Who needs BOCW registration?
Employers and contractors engaged in building or other construction work with the required number of workers, and the project owners who undertake construction, need to deal with registration and cess. Typical cases include:
- Real estate developers and builders constructing residential, commercial and group housing projects
- Civil, electrical, plumbing and finishing contractors who employ construction workers on site
- Government departments and public sector undertakings that carry out construction directly
- Infrastructure contractors on roads, bridges, drains, pipelines, dams and similar works
- Industrial plot owners building sheds or warehouses with their own workforce, though factory-related construction is excluded from the BOCW definition
- Principal employers who engage multiple contractors on a project and remain responsible for cess and safety coordination
Benefits of BOCW Registration
Lawful employment of construction workers
Employing construction labour without the required registration is a contravention under the Code, with fines. Registration puts you on the right side of the law.
Access to approvals and tenders
Authorities, RERA regulators and government clients ask for registration and cess payment proof at plan sanction, completion and bill clearance.
Worker welfare through the Board
Registered workers can access welfare schemes through the State Board, which supports retention and reduces disputes.
Safety framework
The rules prescribe safety committees, protective equipment and health check-ups for older workers, which lowers accident exposure.
Clear cess position
Paying and self-assessing the cess correctly avoids interest, penalty and holds on completion or occupancy certificates.
Applicability and conditions
Apply the following checks to decide what is required for your project.
- The work is building or other construction work, and not work related to a factory or mine, which is excluded from the definition in the Code
- You employ 10 or more workers to count as an establishment, or the State has notified a lower threshold for specified work
- The project is not your own residential construction within the exempted cost limit of ₹50 lakh or a higher notified amount
- You are the employer or contractor, or the principal employer, with identified responsibility for the site
- For worker benefits, workers meet the Board's eligibility conditions, which we have not verified here and which should be confirmed with the State Board
Documents required
Entity and employer documents
- PAN, incorporation or partnership documents and authorisation of the signatory
- GST registration and, where available, Udyam registration
- Contractor licence details and work orders or agreements
Project documents
- Sanctioned building plan or work order showing location and nature of work
- Estimated cost of construction, with a chartered engineer's certificate for cess self-assessment
- Details of principal employer and contractors on site
Workforce documents
- Number of workers expected and their categories
- Worker identity, address and bank details for Board registration
- ESIC and PF registration details where applicable
Step-by-step BOCW registration and cess process
The steps combine the new OSH Code route with the cess and Board practice that continues in the States. Check your State portal for the live procedure.
Decide applicability for each project
Confirm that the work is construction, that you meet the establishment threshold and that no exclusion applies. Do this per project and not only once per company.
Apply for registration of the establishment
Apply electronically in Form-I on the central OSH portal or the State portal. Under the Central Rules the certificate in Form-III is due within 7 days, else deemed.
File the commencement notice
Give the notice of commencement of construction in Form-VI within 30 days, as per Rule 4 of the Central Rules. Also give a cessation notice when work stops.
Compute and pay the cess in advance
Self-assess the cost of construction, pay cess at 1% in advance, as the Social Security Code and rules provide, at approval or before work starts, supported by an engineer's certificate.
Register workers with the Welfare Board
Enrol construction workers through the State Board's portal or offices, with identity and bank details so that benefits can reach them.
Set up safety and welfare arrangements
Put in place the safety, health and welfare measures that the rules require, such as protective equipment, first aid and health check-ups for older workers.
Maintain registers and update changes
Keep registers of workers, wages and accidents, update the registration for changes in details and file returns as notified.
File final cess assessment
After completion, file the final self-assessment within 60 days of completion of each work and adjust against the advance paid.
Government fees and cess
The cess is the main government payment. It is levied at 1% of the cost of construction, fixed by notification S.O. 2322(E) dated 8 May 2026 as reported in the analysis we reviewed, within a statutory band of 1% to 2% in Section 100(1) of the Code on Social Security, 2020. Cost of construction excludes the cost of land and compensation. The registration fee is prescribed in the rules and we could not verify an amount.
| Item | Amount | Note |
|---|---|---|
| BOCW cess on construction cost | 1% of cost of construction | Section 100 of the Code on Social Security, 2020; rate as reported in S.O. 2322(E) of 8 May 2026 |
| Interest on delayed cess | 1% per month or part of a month | Section 101 with Rule 42(2), as reported by Taxmann |
Professional charges are quoted separately after reviewing your case. Government fees and cess are paid directly to the authority or Board.
How long does it take?
Registration under the Central Rules is designed to be fast, with a certificate within 7 days or deemed registration. Real timelines depend on the State portal and on how complete your project papers are. Cess assessment and worker registration should be done before work begins to avoid delays at plan sanction or completion.
| Stage | Typical time |
|---|---|
| Registration certificate in Form-III | Within 7 days under the Central Rules, else deemed |
| Commencement notice in Form-VI | Within 30 days of commencement |
| Final cess self-assessment | Within 60 days of completing each work |
Validity and updates
The OSH Code continues existing registrations and the Central Rules require changes in details to be updated within 30 days. Closure of an establishment is to be notified. Registration is typically valid until cancelled or closure, but State rules may have their own updating requirements, so check the portal. Treat each project's cess and notices as separate events, even when the establishment registration continues.
Compliance after registration
- Give commencement and cessation notices in Form-VI within 30 days
- Pay cess in advance and file the final self-assessment within 60 days of completion
- Provide a free annual health examination to workers aged 40 and above, as the Central Rules provide
- Maintain registers of workers, attendance, wages, accidents and safety equipment
- Appoint a safety committee or officer as required by headcount and nature of work
- Keep ESIC and PF registrations and returns up to date for construction workers
- Update details with the authority within 30 days of any change

Common mistakes and rejection reasons
Treating cess as optional until completion
Cess is assessed in advance. Waiting till the end exposes you to interest and holds on completion or occupancy certificates.
Counting only direct workers
Workers engaged through contractors on your site matter for the threshold and for safety duties.
Applying the factory rules to factory construction
Work related to a factory or mine is excluded from the BOCW definition. Do not assume the BOCW regime applies to every shed.
Registering once and forgetting per-project notices
Each new project needs its own commencement and cessation notices and cess assessment.
No engineer certificate for the cost estimate
Self-assessments without a chartered engineer's certificate invite disputes.
Ignoring State board registration of workers
Employers who register the establishment but not the workers miss the welfare benefits the system is meant to deliver.
Penalties for non-compliance
The Code on Social Security has a penalty provision for cess default in Section 104 and an appeal route in Section 105 against assessment orders, per the analysis we reviewed. The OSH Code contains its own fines for failing to register and for safety contraventions, which our factory licence research records as up to ₹2 lakh, rising to ₹5 lakh for continuing contraventions, but we have not verified section numbers or amounts for BOCW-specific breaches. We do not quote a figure here.
Practitioner tips
- Do the cess self-assessment together with the plan sanction. Authorities in several States hold completion certificates until cess is cleared, and an advance payment is simplest to reconcile at the start.
- Keep one file per project: sanction, cost estimate, engineer's certificate, cess challans, Form-VI copies and worker lists. This is what the inspector or Board officer will ask for.
- Where you use multiple contractors, agree in writing who pays cess and who registers workers, but remember that the principal employer cannot contract out its statutory responsibility.
- Check whether your State is still using its legacy BOCW rules or has notified OSH rules. The forms and portals differ and an old form on a new portal wastes weeks.
- Arrange the health check-up for workers aged 40 and above early in the project, and keep the Form-VIII style certificate records the Central Rules refer to.

BOCW Registration: frequently asked questions
What is BOCW registration?
It is registration of an establishment carrying on building or other construction work so that it can employ construction workers lawfully and comply with safety, welfare and cess duties. The BOCW Act, 1996 is now part of the OSH Code, which came into force on 21 November 2025.
Is the BOCW Act, 1996 still in force?
Its provisions have been subsumed into the OSH Code, 2020, and the related cess law into the Code on Social Security, 2020, from 21 November 2025. Existing registrations and rules continue under transition provisions, and State rules apply until final State OSH rules are notified.
What is the BOCW cess rate?
The cess is 1% of the cost of construction. Section 100(1) of the Code on Social Security allows a band of 1% to 2%, and an analysis we reviewed reports that notification S.O. 2322(E) of 8 May 2026 fixes the rate at 1%. Cost of construction excludes the cost of land.
Who pays BOCW cess?
The employer who undertakes the building or other construction work. It can be collected by deduction at source, in advance through a local authority or paid directly, according to Section 100. The principal employer should make sure the project's cess is paid and documented.
When is cess payable?
As reported, cess is paid in advance on a self-assessment supported by a chartered engineer's certificate, at approval or before work starts. A final self-assessment is due within 60 days of completing each work, adjusted against the advance. Delay attracts interest at 1% per month or part of a month.
What is Form-VI under the new rules?
Under the OSH (Central) Rules, 2026, a commencement or cessation notice for construction work is given in Form-VI within 30 days. Check the State portal for the form that applies to State-sphere projects, since final State rules may differ.
Do I need BOCW registration for building my own house?
The OSH Code excludes construction of one's own residential building where the total cost does not exceed ₹50 lakh or a higher notified amount. Above that, or for commercial or contractor-run work, registration and cess issues may apply. Check the State position before starting.
Is BOCW registration required for factory construction?
The Code's definition of building or other construction work excludes work related to a factory or mine, so BOCW registration is not the route for that work. Factory-related requirements fall under the factory licence and plan approval process instead. Confirm the character of the work before deciding.
How do construction workers register with the welfare board?
Workers apply to the State Building and Other Construction Workers' Welfare Board with identity and address proof and bank details, usually through the Board's portal or offices. Eligibility conditions such as age and days worked are set by the Board and should be confirmed with it.
What happens if I do not pay cess?
Interest runs on delayed cess, and the Code on Social Security has a penalty provision in Section 104 and an appeal route in Section 105. Authorities may also withhold completion certificates or bill payments. Pay in advance and keep challans with the project file.
