The licences required for a restaurant in India are a mix of food-safety, municipal, fire, labour and tax approvals, and the order in which you obtain them decides how smoothly you open. Most restaurants and cafés need an FSSAI registration or licence, a municipal health or trade licence, a fire clearance where the premises qualify, a shop and establishment registration, GST registration and signage permission. Serving alcohol or playing recorded music for customers adds further layers. This roadmap shows what to apply for, in what order, and what a running outlet owes through the year.
Licences and registrations to plan for
- Planning stageUdyam registration
Free registration that classifies your outlet as a micro or small enterprise. Useful for bank loans, schemes and supplier onboarding, and quick to complete online.
- Before openingGST registration
Required once turnover crosses the threshold, and earlier if you supply inter-state or sell through a platform. Restaurants must display the GSTIN and issue tax invoices.
- Before openingFSSAI registration or licence
No food business may operate without it under the Food Safety and Standards Act, 2006. Since 1 April 2026 the tiers are registration up to ₹1.5 crore turnover, State licence up to ₹50 crore and Central licence above that.
- Before openingHealth / trade licence from the municipality
Municipal bodies such as MCD in Delhi and Nagar Nigams in UP and Haryana license eating places for public-health reasons. Fees and exemptions are set locally.
- Before opening (Delhi)Eating house licence (Delhi) and what replaced it
Delhi Police issued this licence under the Delhi Eating Houses Registration Regulations, 2023 until it was withdrawn in June 2025. Check the current local requirement for your premises.
- Before openingFire NOC
Kitchens use gas, oil and heat, and dining areas hold crowds, so fire services expect clearance for premises above their thresholds. The State's fire Act sets who needs it.
- Before hiringShop and establishment registration
State labour department registration for commercial establishments with staff, covering working hours, leave and wages rules.
- Before displaySignage / advertisement permission
A fascia or hoarding on a commercial building can attract permission requirements and fees from the municipal body or NDMC. Delhi courts have treated signboards as advertisements.
- Before serving alcoholLiquor licence (only if you serve alcohol)
State excise licence per category and seating. Serving alcohol without it is an excise offence, so apply well before launch.
- On hiringEPF registration
Applies when your headcount crosses the coverage threshold. Many restaurant groups hit it after opening a second or third outlet.
- On hiringESIC registration
For eligible employees under the headcount and wage ceiling; staff-heavy kitchens often qualify.
- On hiringProfessional tax (where levied)
States such as Maharashtra and Karnataka levy it on salaries; our earlier notes suggest Delhi, UP and Haryana do not, but verify for your State.
The roadmap: what to apply for and in what order
Approvals for an eating place depend on each other more than owners expect. The municipal licence office asks for FSSAI, the fire department asks for a layout, and the liquor department asks for nearly everything else. Applying in the wrong order is the most common reason a launch date slips.
A workable sequence for a new outlet is below.
- Fix the entity and premises. Check that the property permits commercial food use, since lease terms, building use and local zoning can block a food licence.
- Obtain PAN and GST registration, and file Udyam registration.
- Apply for FSSAI on FoSCoS. The Kind of Business and your turnover decide the tier, and the 14-digit number must appear on invoices and be displayed on the premises.
- Apply for the municipal health or trade licence with the FSSAI certificate, premises papers and a layout where required.
- Apply for the fire NOC if your premises or seating cross the State's threshold, ideally before fit-out is finished so that changes are cheap.
- Register under the State shops and establishments law before hiring staff.
- Obtain signage permission before installing the sign, and apply for the liquor licence in parallel if you will serve alcohol.
- Register for EPF, ESIC and professional tax once headcount triggers them.
Delhi's eating house licence: what changed in June 2025
Older guides still list a Delhi Police eating house licence as step one. That licence was issued under the Delhi Eating Houses Registration Regulations, 2023 made under the Delhi Police Act, 1978. As reported by news and legal sources, the Lieutenant Governor's order of 19 June 2025 withdrew the regulations, and the Chief Minister announced the change on 23 June 2025.
In practice this means a Delhi restaurant no longer applies to the police for this licence. The approvals that still matter are the FSSAI registration or licence, the municipal licence from MCD, NDMC or the Cantonment Board, and the fire clearance. Confirm that no replacement rules have been notified and check your local body's current requirement on the day you apply, since the formal notification text was not opened for this page.
Food safety: FSSAI tiers for restaurants
For most single cafés and small restaurants, the tier is registration or a State licence. The turnover limits were reset from 1 April 2026: registration up to ₹1.5 crore, State licence above that up to ₹50 crore and Central licence above ₹50 crore, with the Kind of Business able to override the tier. Registrations and licences are valid perpetually from that date, subject to annual fee and compliance.
Each premises needs its own approval. A chain with outlets in several States needs a licence for each State premises unless it qualifies for a Central licence. The annual FSSAI return (Form D-1) is required mainly from manufacturers, repackers, importers and similar categories, so check on FoSCoS whether your Kind of Business is covered, and keep sales records in order from day one.
Delhi, Uttar Pradesh and Haryana: where the process differs
Delhi: Municipal licences come from MCD (or NDMC in its area) on their portals, the fire service is the Delhi Fire Service, and liquor is under the Delhi Excise Department with annual licences running from 1 April to 31 March. Delhi signboards have been treated as advertisements under section 143 of the Delhi Municipal Corporation Act, 1957, so ask the local body before installing.
Uttar Pradesh: Nagar Nigam or Nagar Palika licences apply, fire clearance runs under the UP Fire and Emergency Services Act, 2022, and shop registration is with the UP Labour Department. Reported UP excise categories depend on the year's policy, so check the current excise policy for any bar or restaurant liquor category.
Haryana: Municipal Corporation or Committee licences apply, the Haryana Fire and Emergency Services Act, 2022 governs fire, and Gurugram's dining belt makes the Haryana excise policy 2025-27 relevant for bar-restaurants. Haryana has also notified an exemption under its shops law linked to its OSH&WC rules, reported by law firms, which was due to operate when the final Haryana rules arrive.
Liquor and music: two optional layers
If you plan to serve alcohol, a separate excise licence is needed in each State, and the category, fee and eligibility depend on seating, zone and the State's current policy. Fees can run into lakhs of rupees in Delhi, and the policy is revised often, so build the timeline around the policy window. See our liquor licence guide, and for a venue whose main business is a bar, see our bar and club roadmap.
Separately, playing recorded music or hosting live performances for customers is a public performance of copyrighted works, and music rights owners and their societies license that use. We have not verified current tariffs or whether a particular society's licence is required at your venue, so confirm with the relevant society before relying on any assumption.
Recurring compliance calendar for a running outlet
Opening is the easier half. A running restaurant has a steady monthly and annual rhythm, and lapses usually come from a missed renewal rather than from a refusal.
- Monthly: GST returns (GSTR-1 and GSTR-3B, or the scheme you opted for), TDS deposit, PF and ESIC contributions, professional tax where levied.
- Annually: FSSAI annual fee (and annual return if your category requires it), municipal licence renewal (commonly by 31 March for MCD, but verify for your body), liquor licence renewal (1 April to 31 March in Delhi), fire NOC renewal as per State rules and income tax filing.
- Daily and ongoing: display the FSSAI licence and GSTIN, maintain hygiene and pest control records, keep staff medical fitness papers and supervisor training certificates ready for inspections.
- On changes: update FSSAI and municipal records for a change of ownership, menu category or address, and inform the shop registration authority as State rules require.
Common pitfalls we see
- Opening on an FSSAI application number alone. The licence or registration must be issued, and inspectors check the displayed certificate.
- Ignoring the building's permitted use. A residential or non-conforming property can block the municipal licence even if FSSAI is in hand.
- Installing signage first and applying later. Removal orders and fees are more expensive than a short wait.
- Missing the fire clearance because the premises seem small. Seating, storeys and kitchen fuel all feed the State's test.
- Letting the liquor application start late. Policy windows and committee schedules do not move for fit-out delays.
- Using an old licence checklist for Delhi. The police eating house step is no longer a requirement as reported.
Frequently asked questions
Which licences do I need to open a restaurant in India?
Usually FSSAI registration or licence, a municipal health or trade licence, a fire NOC where the premises qualify, a shop and establishment registration, GST registration and signage permission. A liquor licence is added only if you serve alcohol. Exact needs depend on your State, location and turnover.
Do I still need a police eating house licence in Delhi?
As reported, the Delhi Eating Houses Registration Regulations, 2023 were withdrawn by the Lieutenant Governor's order of 19 June 2025, so the police licence is no longer applied for. You still need FSSAI, the municipal licence and fire clearance. Confirm the current position with MCD or NDMC before you file.
Is FSSAI registration enough for a small cafe?
A café with turnover up to ₹1.5 crore generally falls in basic registration from 1 April 2026, unless its Kind of Business forces a licence. Above that you need a State licence. You may still need a municipal licence and other approvals, since FSSAI covers food safety only.
Is a fire NOC compulsory for a restaurant?
It depends on the State's fire Act and your building. Thresholds are tied to building height, area or occupancy, and we could not verify a single threshold that applies everywhere. Many restaurants in malls and multi-storey buildings need it, so ask the fire service before fit-out.
What is a health trade licence?
It is a licence from the municipal body, such as MCD in Delhi, for trades that affect public health, including eating places. Fees, validity and exemptions are set by the local body, and some bodies may rely on FSSAI status. Check your municipality's list of licensed trades.
Do I need GST registration for a restaurant?
Once your turnover crosses the threshold for goods and services in your State you must register, and earlier if you supply inter-state or through an e-commerce platform that collects tax. Even below the threshold, registration may help with input tax credit and supplier invoices, depending on your scheme.
Can I play music in my cafe without a licence?
Playing recorded music or hosting performances for customers is a public performance, and music societies license that use. We have not verified current tariffs here. Confirm with the relevant copyright society whether a licence applies to your venue and how it is priced.
How long does it take to open a restaurant legally?
There is no fixed period because each authority runs its own timeline. FSSAI registration can be quick, while State licences, fire clearance and liquor licences depend on inspection and policy windows. Starting the municipal, fire and signage applications in parallel usually saves the most time.
Do I need a separate FSSAI licence for each outlet?
Yes. Each premises needs its own registration or licence, and a multi-State chain generally needs a licence for each State premises unless it qualifies for a Central licence. Keep the Kind of Business and turnover declared consistent across outlets.
