A health trade licence is a municipal permission, issued by the public health department of the local body, for trades that can affect public health, such as eating houses, bakeries, sweet shops, food storage, lodging houses and spas. In Delhi the Municipal Corporation of Delhi (MCD) grants it under the Delhi Municipal Corporation Act, 1957; in Uttar Pradesh and Haryana the equivalent permission comes from the Nagar Nigam, municipal council or committee. This page explains how the health trade licence differs from your FSSAI licence, who needs it, the documents and the sequence that avoids rejection.
What is a health trade licence?
Municipal law in India allows a local body to prohibit certain trades from being carried on in a building unless the occupier holds a licence. The reason is public health: food is cooked, stored or sold, people sleep or bathe, or crowds gather, and sanitation failures spread quickly. The health trade licence is the document that tells you the municipal health wing has accepted your premises and your trade for that purpose.
In Delhi, the MCD splits its licences into a general trade licence for ordinary trade and storage, and a health trade licence for the categories listed in the licensing schedule to the Act. Food businesses such as restaurants, cafes, bakeries and sweet shops are the largest group. Hotels, guest houses, spas, swimming pools and cinemas fall in the same health bucket in the Delhi framework. The exact list of trades and the fee for each is decided by MCD, so check the current notification rather than a consultant's chart.
Your FSSAI licence is not a substitute. FSSAI, a central regulator, controls food safety and quality standards under the Food Safety and Standards Act, 2006. The health trade licence is a local, premises-based permission. A well-run restaurant normally holds both, along with a fire NOC where applicable and, in many cases, a liquor licence if alcohol is served.
One change worth knowing: in June 2025 the Delhi eating house registration regime run by Delhi Police was withdrawn, so the police step that earlier sat beside the MCD licence no longer applies to Delhi restaurants. The MCD health trade licence was not part of that withdrawal. Read the dedicated page on the eating house licence for the details.
Who needs a health trade licence?
Local bodies decide which trades need a health licence, so the list varies by city. The following operators usually have to check and, in most Delhi cases, apply:
- Restaurants, cafes, dhabas, cloud kitchens and canteens that cook and serve food on the premises
- Bakeries, sweet shops, ice-cream parlours and juice or snack outlets
- Food storage, cold storage and warehouses holding food items, where the body classes them as health trades
- Hotels, guest houses, lodging houses and paying-guest accommodation in cities that license them
- Spas, salons, massage centres, swimming pools and gyms where the municipal schedule lists them
- Meat, fish and poultry retail shops, which also need the specific conditions described on our meat shop licence page
Benefits of Health Trade Licence
Lawful operation from the premises
A health trade licence is the answer a municipal inspector expects when he asks whether the trade is permitted at that address. It reduces the risk of challans, closure notices and sealing.
Supports FSSAI, fire and bank formalities
Banks, landlords, food delivery platforms and other licensing bodies often ask for it. Having it on file shortens onboarding.
Public-health credibility
The licence shows that the premises met the local body's sanitation and layout expectations, which matters to customers and corporate clients.
Clear compliance calendar
An annual licence forces a yearly review of hygiene, drainage, pest control and staff health practices that would otherwise be neglected.
Protection when relocating or expanding
A clean licensing record makes the next licence, such as a second outlet or an alcohol licence, easier to obtain.
Eligibility and conditions
The licence is granted to the occupier of the premises for a named trade. Most refusals relate to the premises and to dues, not to the form itself.
- Premises that can lawfully be used for the trade, with conversion or mixed-use charges paid where the property is residential in origin
- Property tax and other municipal dues cleared for the property
- Legal right to occupy as owner, tenant or lessee, with a written agreement
- FSSAI licence or registration where the business is a food business
- Hygiene, drainage, ventilation and water supply that match the conditions of the local body
- No unauthorised construction that the municipal body can object to
Documents required
Applicant and business documents
- PAN and identity and address proof of the proprietor, partners or authorised signatory
- Partnership deed, LLP agreement or incorporation documents, with a board resolution or authority letter if applicable
- GST registration certificate and Udyam certificate where available
- FSSAI licence or registration for food businesses
- Passport size photographs and, for some categories, medical fitness certificates of food handlers
Premises documents
- Sale deed, lease or rent agreement, or allotment letter, with ownership proof of the landlord where asked
- Latest electricity or water bill and property tax receipt
- Site plan or layout of the premises showing kitchen, storage, washing area and seating
- Proof of payment of conversion and parking charges, where the property needs them
- Fire NOC or fire safety documents where the building and category need them
- Indemnity bond or affidavit on the format the body prescribes
Step-by-step process to get a health trade licence
The sequence is similar across Delhi, UP and Haryana, although portals and screens differ. Delhi applicants should follow the latest MCD instructions on mcdonline.nic.in.
Confirm the licensing body and category
Check whether your address falls under MCD, NDMC, a cantonment board, a Nagar Nigam or a development authority such as Noida. Then confirm whether your trade is a health trade or a general trade in that body's schedule.
Obtain FSSAI first for food businesses
Apply for the right tier of FSSAI licence or registration on FoSCoS. Municipal health officers routinely ask for it, and its details should match your trade name and address.
Clear property dues and fire requirements
Pay property tax, conversion and parking charges where relevant. Confirm with the fire authority whether your building needs a fire NOC before the licence is finalised.
Prepare the premises
Set up washable surfaces, drainage, pest-proofing, a hand-wash station, potable water and covered waste bins. Inspectors check these on site and a poor kitchen layout is a leading cause of queries.
File the application online
Fill in the trade code, premises area and ownership details in the portal. These drive the fee, so an error leads to a wrong demand note later. Upload documents in the format asked.
Pay the fee and attend inspection
Pay through the notified route and keep the receipt. A health inspector may visit; keep originals, the FSSAI licence and the layout ready.
Receive, display and diarise renewal
Download the licence, display it at the premises and note the expiry date. Renewal is usually due before the end of the financial year.
Government fees for a health trade licence
We have not been able to verify a current official fee schedule for the health trade licence from the municipal bodies' own portals, so we do not publish figures here. Fee charts on consultant websites are often outdated, and Delhi has been revising its licensing fees.
| Item | Amount | Note |
|---|---|---|
| Delhi (MCD) health trade licence | Per MCD category schedule | Varies by trade category and area; confirm on the MCD portal before paying |
| Uttar Pradesh (Nagar Nigam / Nagar Palika) | Per local bye-laws | Set by each municipal body; not uniform across the State |
| Haryana (Municipal Corporation / Committee) | Per local bye-laws | Set by the urban local body according to its schedule of trades |
Professional charges are quoted separately after reviewing your case. Government fees are paid directly to the authority.
How long does it take?
There is no fixed statutory timeline that we can verify. A complete file for a premises that is already clean of dues can move quickly, while a file that needs inspection, fire clearance or conversion charges will take longer. Never begin food preparation for sale on the assumption that approval will arrive soon.
| Stage | Typical time |
|---|---|
| Document collation and dues check | A few working days |
| Online application and fee payment | Same day once documents are ready |
| Inspection or officer scrutiny | Not fixed; varies by body and category |
| Issue of licence | After approval; varies |
Validity and renewal
Municipal licences are normally annual. MCD licences are understood to run until 31 March of the financial year, so apply for renewal before that date and not after. Late renewal can attract a penalty and, in a long default, sealing. If the trade, address or occupier changes, you need a fresh or amended licence because the permission is tied to the premises and the person. Renewal is also a good time to check that FSSAI, fire NOC and GST details still match.
Compliance after you get the licence
- Display the licence and the FSSAI licence at a visible place in the premises
- Renew before the end of each financial year
- Keep kitchen, storage and washrooms clean and pest-free; keep pest-control and cleaning records
- Keep food handlers' medical fitness and hygiene training records as the FSSAI schedule requires
- Intimate the body of changes to proprietor, trade or area and obtain amendment
- File FSSAI annual returns where applicable and keep trade names consistent everywhere

Common mistakes and rejection reasons
Treating FSSAI as enough
FSSAI is a central food-safety licence. It does not authorise a trade at a municipal level, and an inspector can still issue a challan if the municipal licence is missing.
Wrong trade category
A cloud kitchen applying under a general trade code, or a restaurant applying under storage, can have the application returned or face a later demand for another licence.
Unpaid property dues or conversion charges
Municipal systems link the licence to the property. Unpaid dues on a converted residential premises are a frequent hold-up.
Unfit kitchen layout
Open drains, no hand-wash station, uncovered waste and unwashable walls attract adverse remarks at inspection.
Names and addresses that do not match
A trade name on the FSSAI licence that differs from the rent agreement or GST certificate triggers queries.
Starting operations before the licence
Operating without a licence invites challans and complicates the later application.
Penalties for non-compliance
Carrying on a licensable trade without a licence has traditionally been an offence under municipal Acts, with fine and the possibility of sealing of the premises. Delhi has reportedly shifted many municipal contraventions to civil penalties decided by an adjudicating officer, but we have not verified the current amounts or sections, so we do not publish a penalty table. Always rely on the live notification of the local body.
Practitioner tips
- Do a self-inspection before you apply: stand where the health inspector will stand and check floor, drain, hand-wash, water storage and waste handling. Fixing these before the visit saves weeks.
- For a restaurant, map the stack in this order: FSSAI, fire clearance where required, health trade licence, then liquor licence if you serve alcohol. Alcohol licensing authorities typically ask for the municipal licence.
- When renting, ask the landlord for property tax and conversion receipts before signing. Without them, your licence will stall even if your own papers are perfect.
- In Noida and Greater Noida check whether the Authority, rather than a Nagar Nigam, governs the plot before choosing a portal.
- Keep dated photographs of the kitchen and frontage, and keep a soft copy of every receipt in a single folder for the next renewal.

Health Trade Licence: frequently asked questions
What is a health trade licence?
It is a licence issued by the public health department of a municipal body to trades that affect public health, such as restaurants, bakeries, hotels and spas. It permits the trade at a particular premises and is separate from FSSAI registration, which is a central food-safety licence.
Who issues the health trade licence in Delhi?
The Municipal Corporation of Delhi issues it for most of the city, and applications are made on its online portal. The New Delhi Municipal Council and cantonment boards license premises within their own areas, so first confirm which body covers your address.
Is a health trade licence needed if I already have an FSSAI licence?
Usually yes in Delhi, because the two are issued under different laws for different purposes. FSSAI covers food safety standards; the health trade licence covers the premises under municipal law. Confirm any recent MCD relaxation on the live portal.
Do I need a health trade licence for a cloud kitchen?
A cloud kitchen cooks and packs food for sale, so it is generally treated as a food business and an eating-house style trade by municipal bodies. Check the category with the local body, and take FSSAI approval and a layout that satisfies hygiene conditions.
How long is a health trade licence valid?
Municipal licences are normally annual. MCD licences are understood to run to 31 March, so file the renewal before the year ends. Confirm validity on the licence itself and with your local body.
What documents are needed for a health trade licence?
Typically PAN and identity proof, constitution documents, FSSAI licence, rent agreement or ownership proof, an electricity bill, property tax receipt, a premises layout and photographs. Some categories also need a fire NOC and medical fitness certificates of food handlers.
Is a police licence still required for restaurants in Delhi?
The Delhi Eating Houses Registration Regulations, 2023 were withdrawn in June 2025, so the earlier police registration for eating houses was dropped. The MCD, FSSAI and fire requirements are separate and continue to be assessed on their own rules.
What is the penalty for operating without a health trade licence?
Municipal Acts provide for fine and sealing of the premises for unlicensed trade, and Delhi has moved many such contraventions to civil penalties decided by an officer. The amount depends on the section and body, so check the current notification.
Can I get a health trade licence for a residential premises?
Only if the local body and the master plan allow that use for the trade. Conversion or mixed-use charges must usually be paid first, and some trades are not allowed in purely residential areas. Confirm permitted use before signing a lease.
Does Uttar Pradesh or Haryana have a health trade licence?
Municipal bodies in both States license food and health-related trades under their Municipal Acts and bye-laws, but the name, fee and portal differ by city. Check the Nagar Nigam or municipal committee for your address, or the development authority in Noida and Greater Noida.
