Pollution NOC in Haryana (HSPCB Consent to Establish and Operate)

See how HSPCB consent runs through the HEPC portal, who decides your file, and why Haryana's residential-area bar and new Right to Business law matter to your plan.

Reviewed by Satyam Gupta, Company Secretary (CS) & Advocate · Last reviewed 16 October 2026

A pollution NOC in Haryana is the Consent to Establish (CTE) and Consent to Operate (CTO) issued by the Haryana State Pollution Control Board (HSPCB) under the Water Act, 1974 and the Air Act, 1981. Haryana is built around single-window clearance through the Haryana Enterprises Promotion Centre (HEPC), and its pollution board publishes a written consent procedure that is more explicit than most states'. This page explains how it works for units in Gurugram, Faridabad, Sonipat, Panipat and other Haryana industrial areas, and what the 2026 Right to Business law does and does not change.

Haryana's HEPC portal and single-window setup

HSPCB's consent procedure says applications go through the online portal of the Haryana Enterprises Promotion Centre, with fees paid through an online gateway. HEPC was created under the 2016 notification setting up the Haryana Enterprises Promotion Board, which lists the Pollution Control Board among the departments in its single window. District-level committees headed by the Deputy Commissioner clear projects up to ₹10 crore, and the Board's Regional Officers likewise decide pollution consent for investment up to ₹10 crore.

Larger projects go to an officer on deputation with the Empowered Executive Committee of HEPC. If your investment is close to ₹10 crore, split costs honestly between land, building, plant and machinery, because understating investment to stay with the Regional Officer shows up in later fee and inspection checks.

The residential-area bar and why location comes first

HSPCB's procedure bars industries from operating in the residential areas of municipal corporations and committees, urban authority sectors and villages and in any other approved residential colonies or areas. For Haryana this is the main siting hurdle, particularly for small job-work units that grew inside villages and residential colonies around Gurugram, Faridabad and Sonipat.

CPCB's categorisation report also requires siting in a conforming area. Before drafting the application, confirm that the plot is in an industrial estate or an area with the proper change of land use, and keep the allotment letter or CLU approval ready to upload.

Step-by-step process

  1. Check the residential-area bar and land use

Confirm the plot is in an industrial estate or has proper change of land use, and is not within a residential area or village abadi.

  2. Fix the category

Map your process to the CPCB 2025 list and decide whether you are White, Green, Orange or Red.

  3. Log in to the HEPC portal

Register the unit on the HEPC online portal in the occupier's name and open the consent application.

  4. Submit CTE with fee and security

Upload project, layout, environmental management plan and investment details and pay the fee through the online gateway.

  5. Regional Officer scrutiny and inspection

Respond to queries and facilitate the inspection that precedes the first CTO.

  6. Build, commission controls and apply for CTO

Apply for CTO once the unit and controls are ready; do not start production earlier.

  7. Renew before expiry

Diary the CTO expiry and file renewal in good time; amend before expanding or changing process.

Government fees

HSPCB's procedure says consent fees are as prescribed by the Board from time to time and that performance security depends on investment cost. We could not verify the current slab figures from an official table, so none are quoted.

Frequently asked questions

Which portal is used for HSPCB consent?

HSPCB's written consent procedure says applications go through the online portal of the Haryana Enterprises Promotion Centre, with fees paid through an online gateway. Compliance guides also mention OCMMS, so check the Board's site on the day you file for the screen that currently accepts new CTE and CTO applications.

How long is HSPCB consent valid?

Under clause 3.2.1 of HSPCB's procedure, CTO validity is 5 years for Red, 10 years for Orange and 15 years for Green units. This matches CPCB's ceiling. White category units need no consent. Renewal should be filed well before expiry, and amendments are needed before any expansion or process change.

Can I get consent for a unit inside a residential colony or village in Haryana?

HSPCB's procedure bars industries from the residential areas of municipal corporations and committees, urban authority sectors, villages and other approved residential colonies. If your unit is in such an area you must relocate or regularise the land use before a consent application has a realistic chance.

Who decides my consent file in Haryana?

Regional Officers of HSPCB can grant or refuse consent for Red, Orange and Green units with investment up to ₹10 crore. Larger cases go to an officer on deputation with the Empowered Executive Committee of HEPC. Regional Officers also inspect before the first CTO.

Does the Haryana Right to Business law give me deemed pollution consent?

No. The law is reported to give a Certificate of In-Principle Approval in 15 working days, with a protected window for regular approvals, but deemed approval applies only to the certificate. You must still obtain CTE and CTO from HSPCB. Reports also differ on whether the measure is fully in force, so confirm its status.

What does HSPCB consent cost?

Fees are as prescribed by the Board and computed on the portal from category and investment, with performance security slabs by investment cost. Red and Orange CTO fees can be paid in instalments. We do not quote slab figures because we could not verify the current table.

Do White category units in Haryana need consent?

No. HSPCB's procedure exempts White category units from consent but states that they are not permitted to pollute the environment. Confirm that your exact process is White on the CPCB 2025 list, because a wet process, boiler or chemical step can lift a unit to Green or Orange.

Do I need HSPCB consent before a Haryana factory licence?

Where your activity needs consent, inspectors and project clearance committees expect it, and the HEPC single window tracks pollution consent alongside labour and fire approvals. File the consent and factory papers in step, so that a query on one does not hold up the other.
