A fire NOC in Uttar Pradesh is the fire safety clearance given by the UP Fire and Emergency Services department under the Uttar Pradesh Fire and Emergency Services Act, 2022, for buildings in the classes the Act lists, including industrial, storage and hazardous premises above the Act's area limit. UP's Act was amended by U.P. Act No. 10 of 2026, which raised penalties, so older summaries are now out of date. This page explains the UP position in October 2026 for factory and warehouse owners in Noida, Ghaziabad, Lucknow, Kanpur and other industrial districts.

The UP law and who enforces it
Fire safety in Uttar Pradesh is governed by the UP Fire and Emergency Services Act, 2022, which replaced the older fire service law. The department works through Fire Officers at district level under the Director, and Fire Safety Officers are appointed by owners of larger buildings. The technical benchmark behind the Act is National Building Code 2016, Part 4, which sets requirements on exits, staircases, extinguishers, hydrants, sprinklers and alarms.
The Act reached the statute book in 2022 and was amended by U.P. Act No. 10 of 2026, which increased the penalty amounts in sections 36 and 39. If you are reading a guide that quotes lower figures, it predates that amendment.
Which UP buildings need a fire NOC
The test combines height, area and occupancy class. For factories the key point is that industrial, storage and hazardous classes are listed as special buildings, and mixed-occupancy buildings are caught once such use covers more than 500 square metres.
Do not assume a small unit is exempt. Large kitchens, godowns, cold storages and hazardous stores can be pulled in by occupancy class or area, and a department notice after an incident does not distinguish between exempt and ignored.
- Multi-storied buildings above 15 m
- Special buildings of the NBC classes: educational, institutional, assembly, business, mercantile, industrial, storage and hazardous
- Mixed-occupancy buildings where such use covers more than 500 sq m
- Factories, godowns and cold storages that fall in any of those classes, including units on plots allotted by NOIDA, GNIDA, YEIDA or UPSIDA
Process in UP: plan stage, certificate and the one-month rule
For larger categories, fire clearance is bundled with building plan approval. Nivesh Mitra lists a fire NOC before construction, described as provisional, with a stated service time of 15 days and no fee; both figures come from a secondary description of the portal, so treat them as published targets only. After construction and installation of fire systems, you apply for the fire safety certificate.
The UP Act directs the Fire Officer to check compliance and issue the certificate within one month of an application that has all the documents. Officers inspect after three hours' notice and between sunrise and sunset, unless an industry is working or safety demands otherwise. Observations are given with a compliance deadline, and the sensible route is to rectify and ask for re-inspection rather than file afresh.
Fire Safety Officer and the January and July maintenance certificate
UP places a standing duty on owners of the larger building classes. A Fire Safety Officer must be appointed within 30 days of a notice from the department, and default attracts a charge of ₹10 to ₹50 per square metre of built-up area for each month of default under section 33.
Owners must also file a fire-protection maintenance certificate with the Fire Officer in January and July each year. The Act does not fix a validity period for the certificate; that is left to the rules. We could not locate the UP fire rules with fee, validity and forms, so confirm the live position with your district Fire Officer or on the portal before you plan renewal dates.
Penalties after the 2026 amendment
UP's penalties are tied to both the offence and continuing default. Violating the fire-safety provisions of Chapter V can attract imprisonment up to six months, a fine up to ₹50,000 or both, with up to ₹3,000 per day for a continuing offence under section 31. For failure to take prescribed precautions and general contravention, sections 36 and 39 as amended by U.P. Act No. 10 of 2026 now provide a penalty up to ₹75,000, and up to ₹1,000 per day if continuing. Breaking a seal placed by the fire department can bring up to three months' imprisonment, a fine up to ₹25,000 or both.
We did not verify whether the 2026 amendment removed imprisonment from sections 36 and 39, so rely on the live text of the Act for exact wording.
Documents and practical tips for UP filings
UP files are document-heavy, and your fire papers must match the plan sanctioned by the local authority.
- Sale deed, lease deed or allotment letter and sanctioned building plan or application number
- Architectural drawings and fire-fighting layout with water storage and pump calculations as per NBC 2016 Part 4
- Vendor installation and commissioning certificates for pumps, alarms and extinguishers, with photographs of exits and staircases
- Authority letter or board resolution for a company, and the applicant's ID proof
- Keep the same unit address and occupier name across the Nivesh Mitra Common Application Form, the labour file and the UPPCB consent, so fire queries do not multiply
- Walk the building as an inspector would: open every emergency door, test the alarm panel and run the pump on auto
- Diarise January and July maintenance certificates; our Noida Sector-3 office in Uttar Pradesh can review your file in person if you prefer
Step-by-step process
Classify the building
Note height, covered area, basements and occupancy class and compare them with the UP Act's thresholds, including the 500 sq m mixed-use limit.
Prepare the fire-fighting design
A fire consultant drafts NBC 2016 Part 4 drawings and calculations suited to the UP class of your building.
Seek the plan-stage clearance
File with the plan approval or on Nivesh Mitra for the provisional fire NOC before construction where your category requires it.
Build and install the systems
Install pumps, hydrants, sprinklers, alarms, extinguishers and signage as approved and keep commissioning certificates.
Apply for the fire safety certificate
File with the Fire Officer once systems are ready; the Act expects a decision within one month of a complete application.
Inspection and rectification
Facilitate the Fire Officer's inspection, fix observations within the deadline and ask for re-inspection.
Appoint FSO and file half-yearly certificates
Appoint a Fire Safety Officer within 30 days of a notice and file the maintenance certificate each January and July.
Government fees
We did not find UP's current fire fee schedule from an official source and do not quote amounts. Nivesh Mitra is reported to list no fee for the provisional pre-construction NOC; confirm this, as fee rules sit in the UP fire rules that we could not locate.
| Item | Amount | Note |
|---|---|---|
| Provisional fire NOC before construction | Reported nil on Nivesh Mitra | Secondary source; confirm on the portal |
| Fire safety certificate fee | As per UP fire rules | Not verified; usually linked to building class and area |
| Default in appointing Fire Safety Officer | ₹10 to ₹50 per sq m per month | UP Act s.33 penalty after notice, not a fee |
Frequently asked questions
Which law governs fire NOC in Uttar Pradesh?
The Uttar Pradesh Fire and Emergency Services Act, 2022, as amended by U.P. Act No. 10 of 2026, read with the National Building Code 2016, Part 4 as the technical standard. The UP Fire and Emergency Services department enforces it through Fire Officers at district level.
How long does the UP Fire Officer take to issue the certificate?
The Act directs the Fire Officer to check compliance and issue the certificate within one month of an application with all documents. Nivesh Mitra lists 15 days for the provisional pre-construction NOC, as reported. Actual time depends on the installation passing inspection, so build and test the systems before you apply.
Does my small factory in UP need a fire NOC?
That depends on class and area. Industrial, storage and hazardous buildings are listed special buildings, and mixed-occupancy buildings are covered once such use exceeds 500 sq m. Multi-storied buildings above 15 m are also covered. If you are near a threshold, get a measured plan and ask the Fire Officer for a written position.
What penalties apply in UP after the 2026 amendment?
Violation of Chapter V can attract imprisonment up to six months, a fine up to ₹50,000 or both, plus up to ₹3,000 per day if continuing. For sections 36 and 39, U.P. Act No. 10 of 2026 raised the penalty to up to ₹75,000, with up to ₹1,000 per day for continuing default.
What is a Fire Safety Officer in UP?
A person appointed by the owner of larger buildings to look after fire safety. Under the Act, if the department issues a notice, the owner must appoint one within 30 days, and default attracts ₹10 to ₹50 per square metre of built-up area for each month. The officer also helps with the January and July maintenance certificates.
How often must I file fire papers after getting the NOC in UP?
The Act requires a fire-protection maintenance certificate to be filed with the Fire Officer in January and July each year. It leaves the validity period of the fire safety certificate to the rules, which we could not locate, so confirm renewal and fee details with your district Fire Officer.
Can I apply for fire NOC on Nivesh Mitra?
Nivesh Mitra lists a provisional fire NOC before construction from the UP Fire Services within its service catalogue, with a Common Application Form that generates a Unit ID. Whether the completion-stage certificate is also filed there should be confirmed on the portal and with the district Fire Officer.
Does fire NOC replace building plan approval in UP?
No. The fire certificate does not legalise unauthorised construction. For larger categories fire clearance is bundled with plan approval from the local authority, such as the industrial development authority for your plot. Keep the sanctioned plan and the fire drawings consistent.
